| 520 | |a يتناول هذا البحث بالدراسة والتحليل القضاة في العهد الراشدي -دراسة تاريخية تحليلية-؛ من خلال التعريف بالقضاء لغة واصطلاحا، وكذلك التعريف بفترة الخلافة الراشدة، والخلفاء الراشدين، وتناول القضاة في عهد الخلفاء الراشدين بالدراسة والتحليل؛ من خلال تقديم أسماء الخلفاء، وماهية عملهم؛ للوقوف على أبرز وأهم الصفات الواجب مراعاتها عند اختيار القاضي، كذلك مدى اتصال أو انفصال الخلفاء الراشدين عن أسس وطريقة اختيار النبي صلى الله عليه وسلم للقضاة في الفترة النبوية، من خلال قراءة مراسلات الخلفاء مع الولاة والقضاة في أمر القضاء. وقد خلص البحث إلى أن هناك عددا من الشروط التي اتخذها الخلفاء الراشدون لوضع القضاة، ولم يكن القضاة مستقلون في قضائهم، فمنهم من كان حاكما سياسيا بالإضافة لمنصبه كقاض، كما أن جلهم عادوا في بعض القضايا إلى الحلفاء، كما كان يحق للخصم الرجوع للخليفة إن شعر بالظلم. | ||
