| المستخلص: | This work examines the real meaning of one’s personal disposition and its effect on the legal jurisprudence namely in the fields of fundamentalist, hadithic (hadith: a record of the words and actions of the Islamic prophet Mohammad), or philological disputes. I divided my work into two sections with a preface and an afterword, all written in an analytical descriptive style. At the end of this thesis, one may conclude that one’s disposition determines his own mentality and actions that are still greatly affected by the factors of religion, ethics, family, and society. One may also conclude that there is a strong correlation between disposition and ijtihad (reasoning) in a way that a mujtahid (an Islamic scholar) will gradually get immersed into the knowledge of truth until this quest for truth develops to become the nature of the mijtahid itself. Researchers have always recommended to study and use human sciences to serve the rules of sharia (Islamic law) to promote a more enlightened knowledge based on tolerance, peace, and love of the other. يهدف البحث إلى بيان معنى الشاكلة الشخصية وأثرها في الاجتهادات الشرعية لجهة المنازع الأصولية والفقهية والحديثية. نظمته في تمهيد ومبحثين وخاتمة، واقتفيت فيه المنهج الوصفي التحليلي، وخلصت إلى كون فكر الإنسان وعمله من نتاج شاكلته الشخصية التي تتداعى مؤثرات البيئة والأسرة والدين والأخلاق إلى تكوينها وبنائها، وأن ثمة تلازما وثيقا بين الاجتهاد والشاكلة بحيث إن المجتهد يتدرج في سلم التفقه حتى يصبح الفقه له سجية وطبعاً. وأوصي الباحثين بالإفادة من العلوم الإنسانية في خدمة الشريعة الإسلامية للتوصل إلى معارف إشراقية تسهم في بناء الفرد والمجتمع، بغية الحد من غائلة الغلو والعنف والكراهية. |
