| المستخلص: | The phenomenon of electronic public opinion is among the répercussions of the accelerated use of information and communication technologies that have démonstratif several manifestations, especially in relation to the oversight role, with new dimensions we will try to monitor in this article by first standing on the implications of the concept as an attempt to capture it and clarify the problems Related to its seizure, then highlighting the oversight role of public opinion in its relationship to legal rules in terms of origination, amendment, change, cancellation, enforcement, and finally monitoring new manifestations, by talking about changes that touched its mechanisms, sources, and functions, as well as ways of its interaction and mobility within the framework of the supervisory role assigned It is considered as one of the most important mechanisms of popular control, as it is a popular guarantor of legal enforcement. تعد ظاهرة الرأي العام الإلكتروني من بين انعكاسات الاستخدام المتسارع لتكنولوجيات الإعلام والاتصال الذي أبان على عدة تجليات وتغيرات وتحولات على مستوى هذا المعطي خاصة في علاقته بالدور الرقابي، مكتسياً أبعادا جديدة سنحاول رصدها في هذا المقال وذلك بالوقوف أولاً على دلالات هذا المفهوم كمحاولة للإمساك به وتبيان الإشكالات المتعلقة بضبطه، ثم تسليط الضوء علي الدور الرقابي للرأي العام في علاقته بالقواعد القانونية من حيث النشأة والتعديل والتغيير والإلغاء والنفاذ، وأخيرا رصد المظهرات الجديدة وذلك من خلال الحديث عن التغيرات التي مست كنه الرأي العام وآلياته ومنابعه ووظائفه وكذا سبل وطرق تفاعله وحراكه في إطار الدور الرقابي المنوط به باعتباره أحد أهم آليات الرقابة الشعبية وذلك لكونه ضامنا شعبيا لنفاذ القواعد القانونية. |
