| 520 | |a إذا كان الصلح الأسري آلية قضائية لإنقاذ العديد من الأسر من التفكك والتشرد والضياع، فإن الاهتمام به والاشتغال عليه في الوقت نفسه يكشف ويفضح عمق الأزمة التي تعيشها العديد من الأسر المغربية وباقي الأسر عبر ربوع العالم في ظل التحولات الاجتماعية والاقتصادية والثقافية والتكنولوجية، ويطرح سؤالا عريضا حول كيفية الحفاظ على تماسكها وتفادي انتشار ظاهرة الطلاق والتطليق وما يترتب عنها من ماس من قبيل (الإهمال، التشرد، التطرف والانحلال الخلقي للأطفال والأزواج على سواء...) وعلى الرغم من أهمية الصلح والدور الإصلاحي الذي يقوم به القضاء في سبيل تجاوز الصعوبات والمشاكل التي تعاني منها الأسر، فإن أغلب محاولات الصلح بين الأزواج تعترضها معوقات تحول دون تحقيق الغاية المرجوة من سلوك هذه المسطرة، الأمر الذي يسائلنا عن الأسباب الكامنة وراء ذلك، إذ ما الغاية من زخم تشريعي في ظل غياب تدابير تطبيقية قادرة على توفير أرضية تتطلع لكسب رهان إرساء معالم العدالة التصالحية على مستوى تعاطي القضاء الأسري مع النزاعات الأسرية أملا في إيجاد حلول للحد من ظاهرة التفكك الأسري. | ||

Inspite of the importance of reconciliation and its reforming role that the judiciary takes into consideration in orde to over come the difficulties and issues that families suffer from, most attempts of reconciliation between couples are blocked by some constiaints. That diallow the desirest purpose of the family reconciliation rule, this is the thing that makes us wonder about the real causes behind this. What's the purpose of the legislative momentum through the absence of practical measures that can afford what caube expected to put down the land markes of justice considering family reconciliation in order to give a hope to end the family disputes and to find solutions to stop the family disintegration. | ||
