| المستخلص: | تناولت الدراسة أحكام تصرفات الإمام في بابي الجهاد والعلاقات الدولية، وبيان حدود وضوابط هذه الأحكام المنضبطة بقواعد الشرع ومقاصد الشريعة، في الوقت الذي تتسارع فيه الأحداث على الساحة العربية والإسلامية، وينادي بتطبيق أنظمة الحكم وفق الشريعة الإسلامية، في ظل ما يسمى "الربيع العربي"، وفي الوقت الذي تتنادى الشعوب مطالبة بحقوق وواجبات، وإصلاح وتغييرات، أدت إلى اختلاف آراء، وانقسامات بين أبناء البلد الأمر الذي يستلزم بيان حدود الشريعة فيما يجب للإمام على رعيته من حقوق، وما يجب عليه من واجبات، في بابي الجهادة والعلاقات الدولية. وخلصت الدراسة إلى أن الغاية من الجهاد في سبيل الله هي من أجل إعلاء كلمته، والذود عن حرماته الإسلام والوطن، ونشر رسالة الإسلام في بقاع العالم، وأن الاستعانة بالمشركين في حالة الحرب والعلاقات الدولية متروكة لاجتهاد الإمام المسلم منوطة بتحقيق مصلحة الإسلام والمسلمين، وأن المن على الأسرى متروك لإمام المسلم بما يحقق مصلحة الإسلام والمسلمين، وكذلك فداء الأسرى ومفاداتهم منوطة بهذا الأمر. وأوصت الدراسة بضرورة إعادة قراءة واقعية لقضايا المجتمع الإسلامي المعاصر، وحاجة متصدرو العمل الإسلامي وعلماء الشريعة الإسلامية وأئمة المساجد إلى نظرة تأملية وواقعية في قضايا المجتمع الإسلامي المعاصر، والعمل على إظهار الهدف الرئيس من الجهاد وإقامة العلاقات الدولية بين الدول، ومراعاة المصلحة العامة قبل صياغة الشعارات وتحديث الخطاب الإسلامي وفهم الآخر، وضرورة الرجوع إلى النصوص الوحيين وهدي السلف الصالح، واستمداد الأحكام الشرعية العلمية المتعلقة بالجهاد والعلاقات الدولية في مناحي الحياة المختلفة، ونبذ المناهج المنحرفة المضللة. The study dealt with the provisions of the Imam's actions in the subjects of jihad and international relations, and the demarcation of the limits and controls of these provisions that are regulated by the rules of Sharia and the purposes of Sharia, at a time when events on the Arab and Islamic scene accelerate, and calls for the application of systems of governance in accordance with Islamic Sharia, in light of the so-called "Arab Spring", At a time when the people are calling for demands for rights and duties, reform and changes, which led to differing opinions and divisions between the people of the country, which necessitates clarifying the limits of the Shari'a regarding the rights and duties of the Imam in his parish, in the chapters of jihad and international relations. The study concluded that the purpose of jihad for the sake of God is to uphold God's word, defend His sanctities of Islam and the homeland, and spread the message of Islam throughout the world, and that seeking the help of polytheists in the event of war and international relations is left to the Muslim Imam's decision, which is expected to be based on achieving the benefits of Islam and Muslims, and that releasing the prisoners are left to the assessment of the Muslim Imam. The study recommended the necessity of a realistic re-reading of the issues of contemporary Islamic society, the need of leaders of Islamic work, Islamic scholars and imams of mosques to consider a realistic and contemplative view of contemporary Islamic society issues, and work to show the main goal of jihad and the establishment of international relations between countries, and taking into account the public interest before drafting slogans and updating Islamic discourse and understanding the other, and the need to refer to the texts of the revelations and guidance of the righteous predecessors, and to draw practical legal provisions related to jihad and international relations in different aspects of life, and reject misleading and perverted approaches. |
