| المستخلص: | Family mediation is considered an alternative means of settling family disputes, as it is considered a mechanism for amicably resolving disputes, and an advanced stage of negotiation that facilitates understanding, communication and dialogue between the two conflicting parties in an effort to reach a settlement of the dispute .In view of the necessity for the family field to work on support in order to maintain it and maintain its confidentiality, family mediation stems from the parties 'will to volunteer and choose a positive reflection to resolve the conflict. And the issue of reconciliation between the spouses through the appointment of arbitrators to reform the same between the two sides as directed by the Qur'an and decided by Islamic law, evidence of the adoption of mediation in family disputes according to Sharia, so family mediation came specific in areas. It is an alternative means of justice: To maintain the family entity and resolve conflicts. Islamic law has come up with jurisprudence provisions in the field of managing family disputes to achieve family stability, especially family mediation that builds on negotiation, and is carried out with the participation of a third party that facilitates dialogue between the conflicting parties and helps them to reach; to settle the differences .The areas of family mediation are concerned with resolving disputes between spouses, hence the importance of showing the jurisprudence of family mediation, its methods and characteristics by following the descriptive analytical approach. تعتبر الوساطة الأسرية من الوسائل البديلة لتسوية النزعات الأسرية؛ حيث تعتبر آلية لحل النزاعات بشكل ودي، ومرحلة متقدمة من مراحل التفاوض تسهل التفاهم والتواصل والحوار بين الطرفين المتنازعين؛ سعيا للوصول إلى تسوية النزاع. ونظراً لما يتطلبه المجال الأسري من الدعم وحل النزاع؛ سعيا لاستقراره، جاءت أهمية الوساطة الأسرية النابعة من إرادة الأطراف عن تطوع واختيار انعكاسا إيجابيا لذلك. ومسألة الصلح بين الزوجين عبر انتداب محكمين لإصلاح ذات البين كما وجه القرآن وقررته الشريعة الإسلامية، دليل على اعتماد الوساطة في النزاعات الأسرية شرعا، فجاءت الوساطة الأسرية محددة بمجالات، ومن الوسائل البديلة عن القضاء؛ للحفاظ على كيان الأسرة وحل النزاعات. ولقد جاءت الشريعة الإسلامية ووضعت الأحكام الفقهية في مجال تدبير النزاعات الأسرية لتحقيق الاستقرار الأسري، ولا سيما الوساطة الأسرية التي تبني على التفاوض، وتتم بمشاركة طرف ثالث يعمل على تسهيل الحوار بين الطرفين المتنازعين، ومساعدتهما على التوصل؛ لتسوية الخلافات. وتختص مجالات الوساطة الأسرية بحل النزاعات بين الزوجين، ومن هنا تظهر أهمية إظهار الأحكام الفقهية للوساطة الأسرية ووسائلها وخصائصها عبر اتباع المنهج الوصفي التحليلي. |
