| 520 | |a لم يغفل القرآن الكريم شيئا إلا وتكلم عنه، ومن الأمور التي أولاها المشرع الحكيم عناية خاصة حقوق الناس، وهي من الحقوق التي لا يتسامح الله تعالى فيها، ولا تسقط يوم الدين، إلا بعفو أصحابها ومسامحتهم فيها في الحياة الدنيا. ومازالت الجريمة على اختلاف أشكالها وتباين ألوانها، تتوغل في حياة الناس منذ بدء الخليقة، إلى أن يرث المولى تعالى الأرض وما عليها. وما زالت العقوبات على الجرائم في القوانين الوضعية تختلف على مر الزمان واختلاف المكان، تبعا للاحتياجات الاجتماعية والمصالح الدنيوية، بينما الحدود الشرعية على تلك الجرائم ثابتة لا تتغير؛ لأنها تعمل في بعدين متوازيين، وهما: البعد الأخروي، والبعد الدنيوي، وبتكافل البعدين معا تتحقق السعادة للإنسانية، ويتعمق الشعور بالسكينة والطمأنينة لدى الأفراد والجماعات، وهذا بدوره يخلق نوعاً من أنواع الوقاية للجريمة، الأمر الذي لا يمكن توفره في الشرائع الوضعية، التي لا تعمل إلا في إطار البعد الدنيوي فحسب. وسيظل القرآن الكريم يقدم لنا الكثير من المضامين التربوية، وبخاصة المضامين المستفادة من قصصه الواقعية، ومازالت سورة يوسف تقدم لنا المزيد من العبر والحكم، لوقائعها الفريدة، ومنهجها المتكامل للحياة الإنسانية، والتي منها الجريمة وتشريعاتها العقابية، وتبعا لذلك فقد عالجت هذه الدراسة الجريمة ودوافع الجناة، وكيفية تخطيطهم للجريمة وخطوات تنفيذها، طبقا لورودها في سورة يوسف، ثم ناقشت بعد ذلك الحقوق الشرعية للمتهم، ثم تطرقت بالحديث عن أهم أسس التحقيق في الجرائم الجنائية وآلياته، وسياسة البشر في تطبيق القوانين والعقوبات، ثم أتممت البحث ببيان أهم المبادئ والآداب المستوحاة من ملامح الجريمة والتشريع العقابي، قد تمت معالجة البحث على ضوء الدراسة الموضوعية لسورة يوسف برؤية شرعية معاصرة. | ||
| 520 | |b The Holy Qur’an did not neglect anything without speaking about it, and among these matters that the wise legislator gave special attention is the rights of people, and it is one of the rights that God Almighty does not forgive, and it does not fall on the Day of Judgment, except by pardoning and forgiving its owners in this worldly life. Crime in all its forms continues to penetrate into people's lives from the beginning of creation until the Almighty inherits the earth and what it is on. Penalties for crimes in statutory laws still differ over time and in different places, according to social needs and worldly interests, while the legitimate limits on these crimes are fixed and do not change. Because it works in two parallel dimensions: the otherworldly dimension and the worldly dimension, and with the interdependence of the two dimensions together, happiness for humanity is achieved, and the feeling of tranquility and a sense of reassurance is deepened among individuals and groups, and this in turn creates a kind of protection for crime, which cannot be provided in man-made laws, which are not It works only within the mundane dimension only. The Holy Qur’an will continue to provide us with many educational contents, especially the contents learned from its realistic stories. Surat Yusuf continues to provide us with more lessons and judgment, for its unique facts and its integrated approach to human life, including crime and its punitive legislation. Accordingly, this study addressed the crime and the motives of the perpetrators. And how they plan for the crime and the steps to implement it, according to its narration in Surat Yusuf, then discussed the legitimate rights of the accused, then touched on the most important foundations and mechanisms for investigating criminal offenses, and human policy in the application of laws and penalties, then I completed the research with a statement of the most important principles and ethics inspired by the features of Crime and penal legislation. The research has been dealt with in light of the objective study of Surat Yusuf with a contemporary legitimate view. | ||
