| المستخلص: | الحمد لله رب العالمين، والصلاة والسلام على خير خلق الله أجمعين، خاتم الأنبياء والمرسلين، سيدنا محمد صلى الله عليه وثلم، ثم أما بعد؛ فالهدف من البحث بيان الوسائل التي تحفظ الحقوق، ودفع الشبه والتهم والشك والريبة، وهذا يكون عن طريقين، أحدهما: الشهادة كما في قوله تعالى: (وَاسْتَشْهِدُوا شَهِيدَيْنِ مِن رِّجَالِكُمْ ۖ فَإِن لَّمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌ وَامْرَأَتَانِ مِمَّن تَرْضَوْنَ مِنَ الشُّهَدَاءِ أَن تَضِلَّ إِحْدَاهُمَا فَتُذَكِّرَ إِحْدَاهُمَا الْأُخْرَىٰ ۚ وَلَا يَأْبَ الشُّهَدَاءُ إِذَا مَا دُعُوا ۚ) (البقرة: ٢٨٢)، وثانيهما: الإقرار، فهو أقوى وسائل الإثبات، حيث يقول العلماء عنه: (الإقرار سيد الأدلة). وجاء البحث مبيناً أهمية الإثبات ومشروعيته ووسائل الإثبات بين الشريعة والقانون، ثم بينت وسيلة الإقرار ومفهومه في الشريعة الإسلامية وفي القانون، وكذلك أركانه، ثم وضحت الآثار الشرعية والقانونية المترتبة على وسيلة الإقرار. Praise be to God, Lord of the worlds, and blessings and peace be upon the best of all God’s creation, the Last of the Prophets and Messengers, our Master Muhammad (Peace Be Upon Him), to proceed; The objective of this study is to indicate the means that preserve rights, and to ward off resemblance, accusations and suspicion. This shall be by two ways, one of which is testimony, as in the Almighty saying: (..And bring to witness two witnesses from among your men. And if there are not two men [available], then a man and two women from those whom you accept as witnesses – so that if one of them [i.e., the women] errs, then the other can remind her. And let not the witnesses refuse when they are called upon. And do not be [too] weary to write it,..) [Surah Al-Baqarah, from verse 282]. The second is Confession; which is the most powerful means of proof, as scholars say about it: (Confession is the best evidence). This study indicates the importance of proof, its legitimacy, and the means of proof between Sharia and the law. Then it describes the means and concept of confession in Islamic Sharia and the Law, as well as its fundamentals. This study also explains the sharia and legal implications of the method of confession. |
