| 520 | |a هذا بحث عن (العلاقة بين النحو والأحكام الفقهية في كتاب الاستغناء في الاستثناء للقرافي (ت: ٦٨٤ه) وتتمثل في كتاب الاستغناء بوجه عام وأبوابه الأخيرة على الخصوص العلاقة الوثيقة بين النحو والأحكام الفقهية، وأن كثيرا منها بني على اللغة، والقواعد النحوية، وآراء النحويين؛ لذا استوقفتني هذه العلاقة الوثيقة بين العلمين والتي برزت واضحة في كتاب القرافي- رحمه الله- (الاستغناء في الاستثناء)، وقد بين البحث العلاقة بينهما والتي تتراوح بين التأثير والتأثر، فكثير من الأحكام الشرعية بنيت على الأحكام والقواعد النحوية، ومنها ما استنبط الدليل على الحكم الفقهي من الحكم النحوي، ومنها ما فسر الدليل الشرعي للحكم الفقهي مستندا على الحكم النحوي، وهذه العلاقة المترابطة بين الحكمين الفقهي والنحوي ظهرت جلية خاصة في أحكام الأيمان، والطلاق، والأقارير، والطهارة، وكان لباب الاستثناء أثر كبير في الحكم الفقهي- إلغاء وإثباتا- في هذه الأبواب، ونتيجة لوجود علاقة قوية بينهما في المسائل والفروع موضوع الدراسة، كان لابد من دراسة الأحكام الفقهية على المذاهب الأربعة أو بعضها، كما اقتضت المسائل، التي اتخذت من الحكم النحوي مستندا لتبنى عليه، أو يبنى عليه الدليل، جنبا إلى جنب مع الدراسة النحوية، حتى تتضح العلاقة الرابطة بينهما، وقد توصل البحث إلى عدة نتائج، منها أن الفقه وأصوله لا ينعزل بحال عن علوم اللغة عامة وعن النحو خاصة؛ ذلك أنه مبني على الدليل الشرعي، الناطق باللغة العربية، فكان من الطبعي أن ينبني في كثير من مسائله-إن لم يكن في أغلبها-على أحكام اللغة العربية بما فيها النحو والصرف، هذا وبالله التوفيق. | ||
| 520 | |b This is a research on (the relationship between grammar and jurisprudence in the Book of the Dispensation in the Exception by Al- Qarafi (t: 684 E)), and it is represented in the book of dispensation in general and its last sections that deal in particular with the close relationship between grammar and jurisprudence. Many of these sections are based on language, grammar, and grammarians’ opinions. Therefore, this close relationship between both sciences, which was clearly reflected in the Book of Al Qarafi, May God rest his soul, “The Dispensing in the Exception, grabbed my attention. The research revealed the relation between both sciences which ranges between influence and affectedness, as many of the Islamic rulings were based on grammatical rules and rules, some of which derived evidence of jurisprudence from grammatical judgment, while some explained the Islamic evidence of jurisprudence based on grammatical judgment This consistent relationship between the jurisprudential and grammatical judgments was particularly evident in the terms “rules” of faith, divorce, decisions and purification The section of “the exception” had a significant impact on the jurisprudential judgment – clearly and undoubtedly - in these sections, and as a result of this strong relationship between them in the issues and branches of the study, it was a must to study the jurisprudential judgments on the four doctrines or some of them, as required by the issues which were based on the grammatical judgment or on which the evidence was induced along with the grammatical study, o have it clarified The research accomplished several results, one of which is that jurisprudence and its origins are not isolated in any way from linguistics in general and grammar in particular, because it is based on the Islamic legitimate evidence, spoken in Arabic. Therefore, it was normal to have most of its issues based on the rules of the Arabic language, including grammar. | ||
