| المستخلص: | The mosque is the house of Allah Almighty. It is the most honored spot and the purest place for His worship. This concept has been established among the general Muslims who gather together in it to offer prayers and worship. Until recently, this relationship was based on the spiritual ties that people knew about based on religious teachings. Therefore, the mosque has not previously been a material subject of law.\nHowever, societal changes at all levels, from which the mosque has not been excluded, as it is always at the heart of the mobility of society, formed circumstances that prompted the legislator to intervene and assign it legal and regulatory texts, which constituted a legal framework in its entirety to regulate the building of mosques, organize their activity, and explain their status in society.\nThis abstract translated by Dar AlMandumah Inc. 2021 المسجد هو بيت الله تعالى، وهو أشرف بقعة وأنزه مكان لعبادته، وقد استقر هذا المفهوم لدى عموم المسلمين الذين يجتمعون فيه للصلاة والعبادة، وهذه العلاقة كانت وإلى عهد قريب مبنية على ما تعارف حوله الناس من روابط روحية انطلاقا من التعاليم الدينية، لذلك لم يشكل المسجد سابقا موضوعا من المواضيع المادية للقانون.\nلكن التغيرات المجتمعية على كل الأصعدة، والتي لم يستثنى منها المسجد باعتباره دوما في قلب حركية المجتمع، شكلت ظروفا دفعت المشرع للتدخل وإفراده بنصوص قانونية وتنظيمية شكلت في مجملها إطارا قانونيا يضبط إقامة المساجد وينظم نشاطها ويبين مكانتها في المجتمع.\n Etant considéré comme lieu sacré et réservé essentiellement pour la prière, ainsi que toute autres activistes sociales, culturelles, la mosquée à toujours porté cette notion fondée sur des bases spirituellesémanent des concepts religieuses, ce qu’il la éloigner des sujets régi par la loi.\nUne intervention législative demeure nécessaire face aux multiples changements qu’à connait notre société.\n |
