| 520 | |a إن تنازع الاختصاص هي ظاهرة طبيعية في ظل العمل بالازدواجية القضائية، فإذا كان يسهل التسليم بإمكانية حصول تنازع في الاختصاص داخل القسم القضائي الواحد فمن باب أولى التسليم بحدوثه بين جهات قضائية تختلف من حيث الهياكل والنظم القانونية الناظمة لها، وتكمن أهمية البحث في الإحاطة والإلمام بمختلف جوانب محكمة التنازع بصفتها جهاز تفادي حالات إنكار العدالة بالإضافة إلى حيلولتها دون تناقض الأحكام النهائية الصادرة من الجهات القضائية وهذا ما يحقق حماية قصوى للحقوق وللحريات، انطلق من التساؤل التالي: ما هي آليات عمل محكمة التنازع الجزائرية وما هي أدوارها؟، وتوصلنا إلى أن محكمة التنازع هي هيئة قضائية عليا تحكيمية ودستورية تلعب دورا كبيرا في المحافظة على قواعد الاختصاص النوعي وبالتالي المحافظة على النظام العام، وذلك عن طريق تحديد مجال اختصاص كل جهة قضائية بناء على حالات التنازع المعروضة عليها. | ||
