| المستخلص: | إن استغلال الأطفال في مجال العمل من الظواهر الخطيرة التي لازالت تهدد المجتمعات وتنتشر في أشكال عديدة ومتنوعة وتمارس في مختلف الأنشطة والمجالات. لذا تسعى الدول والمجتمع الدولي إلى مكافحتها، بل والقضاء على أسوء أشكالها، بوضع قواعد ومعايير ووضع برامج واتخاذ تدابير في إطار اتفاقيات دولية. فالتصدي لظاهرة استغلال الأطفال في مجال العمل يقتضي وضع الإطار المفاهيمي الذي يمكن الإعتماد عليه لصياغة قواعد ومعايير وتدابير الحماية. لأن ضعف الطفل وهشاشته وعرضته للإساءة والخطر تبرر اعتباره كفئة من الفئات الاجتماعية الخاصة التي تحتاج إلى رعاية خاصة على نحو ما يستوجبه الدستور وتكرسه النصوص التشريعية والتنظيمية. The exploitation of children in the workplace is one of the dangerous phenomena that continue to threaten societies and is spreading in many different forms and practiced in various activities and fields. This has led States and the international community to combat and eliminate this phenomenon, by establishing rules and standards and the development of programs and measures within the framework of international conventions. Addressing the phenomenon of child labor in the workplace requires an appropriate conceptual framework for the formulation of rules and standards of protection. Because the weakness and fragility of the child, exposed to abuse and danger, justifies considering it as a specific social category that needs special protection, as required by the Constitution and enshrined in legislative and regulatory texts. In this perspective, defining the concept of a child at risk, and thus the concept of exploiting child labor, helps to discover the reality and the content of the protection that is actually devoted to it. This concept is linked to the concept of the rights of the child and its rules of protection. A concept revealed by article 2 the law of July 15, 2015 on the protection of the child within the framework of the rights enumerated by article 3 of the same law. |
