| المستخلص: | The concept of illegal immigration has an indication that this conduct violates legislation, but individuals have the right to movement and relocation freely. This right is guaranteed in international charters and internal legislation under the terms of public freedoms. Based on the right of the State to extend its laws on its territory and to prevent the entry of all those who it does not wish to enter, the international regional and national group has been interested in seeking fundamental solutions that achieve a balance of ambition and interests while respecting rights and freedoms. \nOn this basis, we are trying to clarify the mechanisms taken to address illegal migration and the effectiveness of these mechanisms in respecting human freedoms and rights, both for Algeria and its regional neighbors.\nThis abstract translated by Dar AlMandumah Inc. 2021 Le concept d'immigration illégale a une indication de la violation dela législation par ce comportement, mais les individus ont le droit de se déplacer librement et ce droit est garanti dans les conventions internationales et les lois internes aux termes des libertés publiques. Démarrant du principe où l'Etat applique ses lois sur son territoireet empêchetous ceux qui ne le souhaitent pas de l’entrer, la communauté internationale et régionale et nationale s'est intéressée à la recherche de solutions de fond qui équilibrent les aspirations et les intérêts tout en respectant les droits et libertés. \nSur cette base, nous essayons de clarifier les mécanismes mis en place pour lutter contre la migration illégale et leur efficacité dans le respect des droits de l'homme et des libertés fondamentales, tant pour l'Algérie que pour ses voisins.\n إن مفهوم الهجرة غير شرعية له دلالة على مخالفة هذا السلوك لتشريع ما، غير أنه من حق الأفراد التنقل والانتقال بكل حرية وهذا الحق المكفول في المواثيق الدولية والتشريعات الداخلية تحت بنود الحريات العامة، وانطلاقا من حق الدولة في بسط قوانينها على إقليمها ومنع دخول كل من لا ترغب فيه لدخولها، اهتمت المجموعة الدولية الإقليمية والوطنية في البحث عن حلول جوهرية، تحقق توازن الطموح والمصالح في ظل احترام الحقوق والحريات. \nعلى هذا الأساس، نحاول توضيح الآليات المتخذة لمعالجة الهجرة غير الشرعية، ومدى فعالية هذه الآليات في احترام الحريات والحقوق الإنسانية، سواء بالنسبة للجزائر أو بالنسبة لجوارها الإقليمي. |
