| المستخلص: | The protection of the right at issue May require recourse to the courts and for that, the law requires that the litigant must follow objective rules of law and other procedures so that the victim can obtain his right. The advertising of the real estate action is considered as the procedural legal means to protect the property, and between the attitude of support and the opponents of the algerian justice of the necessity of this procedure the agreed on the need for real estate advertising, but according to the different laws governing real estate, the scope of these actions can sometimes be limited to certain cases and sometimes can be extended to include many actions relating to real estate behavior. قد تقتضي حماية الحق المتنازع عليه اللجوء إلى القضاء، ومن أجل ذلك اشترط القانون على المتقاضي إتباع قواعد قانونية موضوعية وأخرى إجرائية لكي يستطيع المتضرر الحصول على حقه. يعد شهر الدعاوى العقارية الوسيلة القانونية الإجرائية المقررة لحماية الملكية العقارية، وما بين موقف مؤيد ومعارض للقضاء الجزائري حول إلزامية هذا الإجراء استقر الأمر على ضرورة شهر الدعاوى العقارية، غير أنه وحسب مختلف القوانين التي تنظم الوعاء العقاري فإن نطاق هذه الدعاوى قد يضيق أحيانا لتقتصر على بعض الدعاوى العقارية وقد يتسع أحيانا ليشمل الكثير من الدعاوى المتعلقة بالتصرفات العقارية. |
