| المستخلص: | Le code de l’urbanisme est considéré comme le cadre légal des opérations qui tentent d’édifier des constructions, les aménager, et les gérer en vertu des textes législatifs et règlementaires permettant à l’état et aux collectivités territoriales de jouer leur rôle dans le domaine urbain, notamment, l’exerce de l’autorité administrative par l’organisation et par le contrôle des procédures d’aménagement et d’urbanisme, en utilisant des moyens légaux comme les autorisations et les attestations, et parmi les certificats administratifs dans le domaine urbain, il existe un certificat d’urbanisme qui est délivré à la demande de toute personne intéressée, indiquant ses droits à construire, et les servitudes de toutes natures affectant le terrain considéré (le terrain à bâtir). يعتبر قانون العمران الإطار القانوني للعمليات الرامية إلى إقامة بنايات وتجهيزها والتحكم فيها بمقتضى نصوص تشريعية وتنظيمية تمكن الدولة والجماعات الإقليمية بالقيام بالدور المنوط بها في المجال العمراني، لاسيما ممارسة الضبط الإداري في المجال العمراني عن طريق تنظيم ومراقبة إجراءات التهيئة والتعمير وذلك باستخدام وسائل قانونية، المتمثلة في الرخص والشهادات، ومن بين أهم الشهادات الإدارية في المجال العمراني، ما يسمى بشهادة التعمير وهي الوثيقة التي تسلم بناء على طلب من كل شخص معني، تعين حقوقه في البناء والارتفاقات التي تخضع لها الأرض المعنية بالبناء. In particular, the practice of administrative control in the urban field by organizing and monitoring procedures for preparation and reconstruction using legal means, such as licenses and certificates.
