| 520 | |d Malgré l’arsenal des textes juridique établis dans le domaine du construction et de l’urbanisme pour préserver la trame urbaine, sauf que ces textes n'ont pas été efficaces et il a été reproché que les mesures de dissuasion sont insuffisantes en cas de contravention des dispositions du construction et d’urbanisme, ce qui a conduit à la propagation de la construction désorganisée, et afin de diminuer ce phénomène; Législateur algérien a promulgué une loi spéciale pour réglementer le domaine urbain par lequel il à établit des contrôles qui doivent être respectées et prise en compte lors la construction de chaque bâtiment, comme il à introduit une entité administrative dissuasif, son rôle est de vérifier si les gens respectent ces règles, et tout violation de ces règles peut être puni par des sanctions dissuasives financières et autres sanctions qui arrive jusqu’à même la privation de liberté; et c’est ce que nous allons étudier plus en détail dans notre travail de recherche. | ||
| 520 | |a على الرغم من ترسانة النصوص القانونية الصادرة في مجال البناء والتعمير والتي تسعى للحفاظ على النسيج العمراني إلا أنها لم تثبت فعاليتها والتي أعيب عليها قصور التدابير الردعية في حالة مخالفة أحكام البناء والتعمير، مما أدى إلى انتشار ظاهرة البناء العشوائي بشكل رهيب، وللحد من هذه الظاهرة عمل المشرع الجزائري على إصدار قانون خاص ينظم المجال العمراني ووضع بموجبه ضوابط يجب احترامها ومراعاتها عند الإقدام على تشييد أي بناية، كما استحدث جهاز إداري فعال رادع مهمته مراقبة مدى احترام الأفراد لهذه القواعد وأي إخلال بهذه القواعد يعرض مرتكبيها لعقوبات ردعية مالية وأخرى سالبة للحرية، وهذا ما سنتطرق له بالتفصيل في هذه الدراسة. | ||
| 520 | |f Despite the arsenal of legal texts issued in the field of construction and reconstruction that seek to preserve the urban fabric, they have not proved effective, which is characterized by the lack of deterrent measures in case of violation of building and reconstruction provisions. This has led to the terrible spread of the phenomenon of random construction. In order to reduce this phenomenon, the Algerian legislator has worked to issue a special law regulating the urban sphere and establishing controls that must be respected and observed when constructing any building. An effective administrative and deterrent body has also been established to monitor the extent to which individuals respect these rules and any violation of these rules exposes the perpetrators to financial and custodial penalties.
