| المستخلص: | The political life is animated in Algeria by the emergence of the constitutional modification movement after the decision of the president Abdelaziz BOUTEFLIKA to designate a commission of experts in order to elaborate a preliminary project of the law concerning the constitutional modification which has touched a lot of parliament competence in the organic laws field, to permit to the nation council to have the right of initiative of law the organization of the constitutional council ...ect. Those subjects and missions need a real review in order to follow up the recent developments because this modification is emerged in period during which the Arab world witnesses a curtail events, political development and a democratic transfer. For the first time in the political history of Algeria it exists the participation of the political authors in order to enrich the constitutional document project ,it is an important advantage realized by Algeria in the national position in application of the democratic collaboration and the tentative to reach an harmonic constitution approved by all the political powers in society on account of the volume of modification concretized by the president ,and the strengthen of the legislative authority in a lot of sides in order to catch the deficiency and the constitutional holes which were resulted by the constitution of 1996. لقد انتعشت الحياة السياسية في الجزائر بانبعاث حركة التعديل الدستوري بعد قرار الرئيس عبد العزيز بوتفليقة تعيين لجنة خبراء لإعداد مشروع تمهيدي للقانون المتعلق بالتعديل الدستوري والذي مس العديد من الجوانب منها: تعزيز الحقوق والحريات، توسيع صلاحيات البرلمان في مجال القوانين العضوية، تمكين مجلس الأمة من حق المبادرة بالقوانين، تنظيم المجلس الدستوري ...إلخ. وتعتبر هذه المواضيع المهام بحاجة إلى مراجعة حقيقية لتواكب التطورات الحاصلة لا سيما وأن هذا التعديل جاء في مرحلة يشهد فيها العالم العربي أحداث حاسمة وتطورات سياسية وانتقال ديمقراطي. ولأول مرة في تاريخ الجزائر السياسي تتم مشاركة الفاعلين السياسيين لإثراء مشروع الوثيقة الدستورية، وهو مكسب هام حققته الجزائر على الصعيد الوطني تطبيقا للديمقراطية التشاركية، ومحاولة الوصول إلى دستور توافقي تجمع عليه كل القوى السياسية في المجتمع بالنظر إلى حجم التعديلات التي بادر بها الرئيس، وتعزيز مكانة السلطة التشريعية في العديد من الجوانب لتدارك النقائص والثغرات الدستورية التي خلفها دستور 1996. |
