| المستخلص: | تعد حقوق الإنسان وحدة واحدة غير قابلة للتجزئة أو الانتقاص ومن بين تلك الحقوق الأساسية الحق في السكن الملائم. وحق السكن الملائم هو أحد الحقوق الأساسية المتمثل في المأوى أو الفراغ الذي يقي الإنسان من العوامل الخارجية ويوفر حاجاته الضرورية. وقد طرأ على حق السكن الملائم تغيرات عديدة فلم تعد تقتصر على السقف والجدران بل تعدى الأمر إلى الملاءمة من الناحية الاجتماعية والثقافية والموقع وضرورة توافر الخدمات الأساسية والشخصية والطبيعة لساكنيه. وقد أولت المواثيق الدولية لحقوق الإنسان اهتماما كبيرا بالحق في السكن الملائم بعده جزء أساسيا من حقوق الإنسان، فلم يعد حق الإنسان في السكن الملائم موضوعا أو حقا شخصيا بل أصبح حقا جماعيا دوليا تستوقفه التشريعات الدولية والهيئات الدولية المهتمة بحقوق الإنسان ولا يمكن أن يكون حق السكن الملائم بأي حال من الأحوال أن يعني حدا أدنى يمكن من خلاله ضمان البقاء، بل هو شرط أساسي للحريات المختلفة كالانتماء إلى جماعة معينة وإقامة الصلات والعلاقات. ويتميز الحق في السكن الملائم بأهمية كبيرة نظرا لارتباطه بالحقوق الاقتصادية والاجتماعية والثقافية وغيرها من الحقوق المترابطة مع بعضها البعض. ولا يمكن أن ينظر إلى حق الإنسان في السكن الملائم بمعزل عن الحقوق الأساسية للإنسان فهو مرتبط بحق الإنسان في أن يختار إقامته بحرية وألا يخضع لأي تدخل تعسفي في خصوصيته أو منزله ومراسلاته. ولحق الإنسان في السكن الملائم لابد من تدخل الدولة والمجتمع الدولي وأهمها اعتراف الدولة والحكومات بحق الإنسان في السكن الملائم والعمل على حمايته وتعزيزه بتوفير الخدمات الأساسية لهذا الحق من ماء وكهرباء وطرق...إلخ. وحق الإنسان في السكن الملائم هو حقه في أن ينعم بما هو أكثر من سقف وأربعة جدران وهو حق كل رجل وامرأة وشاب وطفل في الحصول على بيت آمن يؤويه ومجتمع محلي ينتمي إليه أو يعيش فيه بسلم وكرامة.
