| المستخلص: | تهدف الدراسة إلى بيان الرؤية الفقهية التي عالجت موضوع مجهول النسب، باعتباره من المواضيع التي شغلت الباحثين الاجتماعيين والاقتصاديين والنفسيين والقانونيين والأطباء كل في مجاله وذلك لأهمية الموضوع وآثاره, بينما نجد أن مباحث الفقه الإسلامي تناولت الموضوع وأثرته بالشروح والأحكام والوقاية والمعالجات والحقوق مما يجعل مجهول النسب متصالحا مع نفسه ومجتمعه، ومتعايشا مع المجتمع وعضواً فعالا، له من الحقوق والواجبات بوصفه فرداً من أفراد المجتمع، ولبيان تلك الرؤية تم استخدام المنهج الاستقرائي، وتوصلت الدراسة إلى نتائج وتوصيات، ومن النتائج: يعاني مجهول النسب مشاكل خاصة بالأوراق الثبوتية في السجل المدني. يعاني مجهول النسب من مشاكل نفسية واجتماعية وذلك لحرمانه الأسري ونظرة المجتمع له لا توجد إحصائيات دقيقة لهذه الظاهرة. يفضل علماء النفس توضيح الحقيقة لمجهول النسب في سن الثانية إلى السادسة. ومن التوصيات: على الدولة أن تخصص في قانون الطفل قوانين تحمي مجهول النسب، على أن تعتمد الكفالة والرضاعة كوسيلة للرعاية، وبديل للتبني للحفاظ على مجهول النسب. لابد من التنسيق بين وزارة الصحة الداخلية والرعاية الاجتماعية في استخراج الأوراق الثبوتية لمجهول النسب. لابد من وضع استراتيجية للوقاية من ظاهرة مجهول النسب ومكافحتها مدعومة بالإحصائيات. يجب مراجعة دور الحضانة مع وضع الأسس لها حتى تسهم في دور حماية مجهول النسب كما يجب أن تتكفل الدولة بإعانة ورعاية مجهول النسب. The study aims to clarify the jurisprudential vision that dealt with the subject of unknown descent, as one of the topics that oc¬cupied social researchers, economists, psychologists, jurists and doctors in their respective fields because of the importance of the subject and its effects. In addition, rights, which makes the un¬known descent reconciled with himself and his community, and coexist with the community and an active member, has rights and duties such as members of the community, and to demonstrate that vision was used inductive method, and the study reached the findings and recommendations, and those results: An unknown de¬scent suffers from problems related to documents in the Civil Reg-istry. Anonymous descent suffers from psychological and social problems due to his family deprivation and the society’s percep¬tion of him. There are no accurate statistics for this phenomenon. Psychologists prefer to clarify the truth of the unknown lineage at the age of two to six. Recommendations: The State shall allocate in the Child Law laws to protect the unknown, if sponsorship and breastfeeding are adopted as a means of care, and an alternative to adoption to preserve the unknown. There must be coordination between the Ministry of Internal Health and Social Welfare in ex¬tracting identification papers of unknown descent. We must develop a strategy for the prevention and control of the phenome¬non of unknown descent and supported by statistics. Nurseries should be reviewed with the foundations for them to contribute to the role of protection of unknown parentage. The state should also provide for the assistance and care of unknown parentage. |
