| المستخلص: | تناولت هذه المستلة موضوع "الشروط المعتبرة في أهل الحل والعقد دراسة مقارنة" وتكمن إشكالية البحث في جملة من الأمور منها: أولا: الاختلاف بين الفقهاء حول بعض الشروط اللازم توافرها في أهل الحل والعقد. ثانيا: مشكلة عملية حيث يشير البحث إلى الواقع السياسي المجتمعي الذي اختلف كثيرا عن نظيره في الأزمان السالفة مما يفرض على الفقهاء ضرورة مراعاة تلك المستجدات. وقد جاء هذا البحث ليجيب عن أسئلة منها: أولا: ما الشروط المتفق على ضرورة توافرها فيمن يشغل منصبا في مؤسسة الحل والعقد؟ ثانيا: هل يجوز انضمام غير المسلمين لمؤسسة الحل والعقد؟ ثالثا: هل يجوز انضمام المرأة لمؤسسة الحل والعقد؟ كل ذلك من خلال عرض مذاهب الفقهاء حول تلك الشروط مع الترجيح مع ذكر سبب ذلك. وقد توصل الباحث إلى جملة من الأمور منها: أولا: الشروط المتفق عليها بين الفقهاء فيمن يعمل ضمن مؤسسة الحل والعقد. ثانيا: حكم انضمام غير المسلمين أو النساء لأهل الحل والعقد. ثالثا: ضرورة مراعاة الفقهاء لما جد من واقع مجتمعي وسياسي-على الصعيدين المحلي والإقليمي والدولي-في حياة الأمة الإسلامية. وتتلخص توصيات البحث في جملة أمور منها: أولا: ينبغي على المجامع الفقهية أن تضع تصورا شرعيا مواكبا لما جد في واقع الأمة سياسيا ومجتمعيا. ثانيا: لا بأس من الاقتباس من النظم السياسية المعاصرة بما يدعم مقاصد السياسة الشرعية ويحقق غاياتها. This article deals with the topic of "the conditions considered in (Ahl al- Hall wa'l-Aqd) the Influential People in the Islamic parliament: a comparative study" The research problem lies in a number of things, including: 1. The disagreement among jurists about some of the conditions that must be met by (Ahl al-Hall wa'l-Aqd)Influential People. 2. A practical problem, where the research refers to the societal and political reality that differed greatly from its counterpart in previous times, which imposes on the jurists the need to take into account these developments. The research came to answer questions, including: 1. What are the conditions agreed upon that they must be met by whoever occupies a position in the institution of influence? 2. Is it permissible for non-Muslims to join the institution of influence? 3. Is it permissible for a woman to join the institution of influence? Answers presented the doctrines of the jurists regarding those conditions with the weighting and the reason for that. The researcher has reached a number of things, including: 1. The conditions agreed upon by the jurists regarding whoever works within the institution of influence. 2. The ruling on non-Muslims or women joining the institution of (Ahl al- Hall wa'l-Aqd) the Influential people. 3. The necessity for the jurists to take into consideration the societal and political reality - at the local, regional and international levels - in the life of the Islamic Ummah. The research recommendations are summarized some issues including: 1. The Fiqh Councils must develop a legal concept that corresponds to what happened in the reality of the Ummah politically and socially. 2. There is nothing wrong with quoting from contemporary political systems in a way that supports the purposes of legitimate politics and achieves their goals. |
