| المستخلص: | هذا البحث بعنوان: القواعد الفقهية المتعلقة بالمصالح والمفاسد وبيان أحكامها وفروعها وتطبيقاتها.. وقد هدف البحث إلى تسليط الضوء على بعضي القواعد الفقهية، لاسيما تلك التي نفرق بها بين المصالح والمفاسد؛ لتسلم عبادة المؤمن من المفسدة التي تنافي التعبد الخالص لله تعالى، ولتحقيق هدف البحث فقد جمع الباحث هذه القواعد وشرحها شرحا علميا متبعا في ذلـك خطوات علمية دقيقة، من: ذكر القاعدة، ثـم يليها صيغ القاعدة، ثم مفرداتها، ثم معناها الإجمالي، ثم أدلتها، ثم أقوال العلماء فيها، ثم الفروع الفقهية، ثم المستثنى من القاعدة -إن وجد-. وقد خلص البحث في نتائجه إلـى: أن هاتان القاعـدتان المهمتـان لا يستغني عن معرفتهما وفقههما مسلم -فضلا عن طالب العلـم-؛ لما لهما من صلة وثيقة بمعاملات الناس وحياتهم اليومية ومشكلاتهم الاجتماعية. وأوصت الدراسة بمواصلة القراءة عن هذه القواعد ونظائرها مما لا يستغني عن معرفته مسلم فضلا عن طالب علـم، وهي من أهـم القواعـد التي يحتاجها المسلم في حياته اليومية، وعليها مدار الأحكام. This research is entitled: The jurisprudential rules related to interests and evils and the statement of its provisions, branches and applications. The aim of the research is to shed light on some of the jurisprudential rules, especially those that distinguish between interests and evil; to accept the worship of the believer from the corrupt that is contrary to the pure worship of God. To achieve the goal of the research, the researcher collected these rules and explained them scientifically, From: the rule of aUQaeda, followed by the formulas of al-Qaeda, then its vocabulary, then its general meaning, then its evidence, then the statements of the scholars, then the jurisprudential branches, and then the excluded from the rule, if any. The research concluded that these two important rules do not detract from their knowledge and jurisprudence, as well as from the student of knowledge, because they are closely related to people's transactions, daily lives and social problems. The study recommended continuing reading about these rules and their analogies, which is indispensable to know Muslim as well as student science, which is one of the most important rules needed by the Muslim in his daily life, and the orbit of judgments. |
