| 520 | |a تهدف الدراسة إلى بيان مدى توافق التأجير التمويلي مع مقاصد الشارع، بالإضافـة إلى بيـان أهمية التأجير التمويلي الاقتصادية للدولة وللأفراد ولاسيما أن التمويل التأجيري يعتبر من الصيغ التمويلية التي ساهمت في النهضة الاقتصادية والاستثمارية ومحاربة البطالة، وقد أثبت التأجيل التمويـلي فاعليته في وقت أحجمت فيه مصادر التمويل التقليدية من تمويل المشروعات، وسوف نستخدم المنهج الاستقرائي الذي يبين كل ما تقدم. وخلصت الدراسة إلى مجموعة من النتائج والتوصيات. من أهم النتائج والتي تتمثل في أن التأجير التمويلي يجمع عددا من العقود وبالتالي ما هو إلا تطوير لها، كما أن التأجير التمويلي أثبت فاعليته الاقتصادية في المشاريع التنموية والخدمية ومحاربته للبطالة، ومن أهم التوصيات، على هيئة الرقابة الشرعية تقنين التأجير التمويلي ووضع الشروط التي تجعل من الصيغ التمويلية التـي لا تشوبها شائبة مخالفـة لأحـكام الشريعة الإسلامية، نوصي الجامعات ومراكز البحوث المتخصصة بتدريس عقد التأجير التمويـلي مقارنة بالعقـود المشابهة. | ||

The most important results, which are that the financial leasing collects a number of contracts and therefore is only a development for them, as the financial leasing has proven its economic effectiveness in development and service projects and fighting it for unemployment, and among the most important recommendations, the Sharia Supervisory Board is legalizing the financial leasing and setting conditions that make formulas Funding that is not impeccable in violation of the provisions of Islamic Sharia, we recommend universities and specialized research centers to teach finance leasing compared to similar contracts. | ||
