| 520 | |a نظرية السيادة من النظريات الهامة في مجال القانون الدستوري، نظرا لتأثيرها على شرعية السلطة وحدودها، وقد أخذت دساتير الدول الحديثة بهده النظرية ومن بينها الدساتير الجزائرية، وتنقسم هده النظرية إلى نوعين نظرية سيادة الأمة ولها نتائجها ونظرية سيادة الشعب لها كذلك نتائجها. وهناك من أخد بالنظريتين وجمع ينهما ومنهم المؤسس الدستوري الجزائري، عبر الأخذ ببعض آليات نظرية سيادة الأمة ونظرية سيادة الشعب، ومن أجل تكريس سيادة الشعب أو الأمة لابد من توافر بعض الضمانات من أجل التجسيد الفعلي لهذه السيادة. | ||
