| 520 | |a اهتم المشرع الجزائري بمكافحة ظاهرة الهجرة غير الشرعية، وذلك من خلال اعتماد عدة آليات قانونية لتحصين الإقليم من هذه الظاهرة الخطيرة، ولعل أهمها ذلك الإجراء الإداري المتمثل في إبعاد كل أجنبي يشكل تواجده تهديدا للنظام العام ولأمن الدولة الجزائرية إعمالا لمبدأ سيادة الدولة على إقليمها؛ ونظم المشرع هذا للإجراء بموجب القانون رقم 08-11 المتعلق بشروط دخول الأجانب إلى الجزائر وإقامتهم بها وتنقلهم فيها. لما كان الحق في التنقل واختيار مكان للإقامة من الحقوق المكفولة للإنسان في مختلف الصكوك الدولية المعنية بحقوق الإنسان وكنا في التشريعات الداخلية للدول، فقد اعترف المشرع الجزائري بمجموعة من الضمانات للإجرائية التي تضمن حماية حقوق الأجنبي المبعد، وما تهدف إليه هذه الدراسة هو البحث عن مدى فعالية هذه الضمانات في حماية حقوق هذا الأجنبي. | ||
| 520 | |b The Algerian legislator was interested in fighting against the phenomenon of illegal immigration, adopting several legal mechanisms to immunize the territory from this dangerous phenomenon, The most important of them is the administrative procedure represented in the expulsion of all foreigner whose presence constitutes a threat to public order and the security of the Algerian State, in application of the principle of State sovereignty over its territory. The legislator regulated this procedure by law n ° 08-11 of June 25, 2008 relating to the conditions of entry, stay and movement of foreigners in Algeria. The right to move and to choose a place of residence being one of the rights guaranteed to the human being in the various international instruments relating to human rights, as well as in the domestic legislation of the countries, Consequently, the Algerian legislator recognized a set of procedural guarantees which guarantee the protection of the rights of the expelled foreigner.
