| المستخلص: | ركز هذا البحث والمعنون بـ: "الإجراءات القضائية للحد من انتشار فيروس كورونا الجديد (covide -19) في المؤسسات القضائية في المملكة العربية السعودية "دراسة تأصيلية تحليلية" على بيان التأصيل الشرعي والتحليل للإجراءات التي اتخذتها القيادة الرشيدة -حفظها الله- للحد من انتشار فيروس كورونا في المؤسسات القضائية في المملكة العربية السعودية وهي تأجيل جلسات جميع القضايا المنظورة لدى جميع المحاكم خلال فترة تعليق الحضور إلى مقرات العمل للحد من انتشار فيروس كورونا، وإطلاق خدمة التقاضي عن بعد للحد من انتشار فيروس كورونا، وتعليق تنفيذ الأحكام القضائية في الرؤية والزيارة للحد من انتشار فيروس كورونا، وتعليق تنفيذ عقوبة حبس المدين في قضايا الحق الخاص، مع الإفراج المؤقت بشكل فوري عمن حبس تنفيذاً لتلك الأحكام والأوامر للحد من انتشار فيروس كورونا الجديد (covide -19). والباحث يوصي في بحثه بضرورة مراجعة الأنظمة القضائية في المملكة العربية السعودية والموائمة بينها وبين الظروف الطارئة، والتطرق إلى تلك الظروف الطارئة وطريقة تعامل الأنظمة معها، وسن ووضع اللوائح والأنظمة القضائية المتعلقة بالتقاضي الإلكتروني، مع التوسع في الدورات التدريبية للقضاة ومساعديهم في طريقة التعامل مع هذه النقلة النوعية في التقاضي، والاستفادة من التجارب العملية في جانب الاحترازات القضائية Praise be to God alone, and blessings and peace be upon the one after whom there is no prophet. And their assistants in the way to deal with this paradigm shift in litigation, and to benefit from practical experiences in the aspect of judicial precautions. |
