| المستخلص: | تعد ظروف المجتمع والبيئة المحيطة به هي المحرك الأساسي في إنشاء وتعديل النصوص القانونية. لذا لا يتصور أي نظام من الأنظمة يكن صدوره بعيدا عن الواقع الذي وجد من أجله. وتكمن المشكلة في مدى ملائمة تلك الأنظمة مع الواقع ومدى قابليتها للانصياع مع المستجدات اليومية والتطورات المتلاحقة المذهلة في ذلك العصر. مما يتعين علينا أن نعيد النظر في دور اللوائح بشكل كبير خاصة أنها أكثر الأنظمة قابلة للتطوير والتغيير عن غيرها من باقي الأنظمة الأخرى. فنرى الأنظمة الأساسية والدساتير داخل الدول تعتبر أنظمة جامدة لا يمكن تعديلها بسهولها، وذلك لصعوبة تغييرها من الناحية الشكلية والموضوعية. وقد نرى الأنظمة العادية أكثر مرونة منها. إلا أن تعديلها أيضا يستغرق فترة ليست بالقليلة من الوقت. أما إذا أمعنا النظر في اللوائح سنجدها الحل الأمثل في عصرنا الحالي القابل للتطوير والتغيير مسايرة للواقع الذي نعيشه. من هنا جاءت أهمية البحث نحو إلقاء الضوء على تلك اللوائح لمعرفة دورها البارز في حل الأزمات الاقتصادية والاجتماعية. Community conditions and the surrounding environment are the primary drivers in creating and modifying legal texts. Therefore, no system of systems can be imagined that can be released away from the reality in which it is found. The problem lies in the extent to which these systems are compatible with reality and their ability to comply with the daily developments and the subsequent developments of the era. Which makes us reconsider the role of regulations differently, especially as they are the most scalable systems and change from other types of systems. We see statutes and constitutions within countries as rigid systems that cannot be easily modified, because of the difficulty of changing them in terms of formality and objectivity. We may see the regular systems more flexible, but the amendment also takes quite a while, but if we look at the regulations we will find the best solution in our time, which can be developed and change in accordance with the reality we live. Hence the importance of research to shed light on these regulations to know their prominent role in solving economic and social crises. |
