| المستخلص: | This research deals with the rules related to the fathers and children regarding the sacrifice, and the identification of the views of Islamic doctrines in this regard. It also aims to identify the criteria for 'the abuse of right' concept and to what extent it can be applied to answer the questions of the research. The researcher has concluded that there is a disagreement among jurists in the ruling on the sacrifice of fathers on behalf of children, young and old, as well as in the ruling on the sacrifice of children on behalf of fathers, both dead and alive. The research has also concluded that it is possible to apply the criteria for the abuse of right in these cases. يتناول هذا البحث الأحكام الخاصة بالآباء والأبناء في الأضحية، والتعرف على آراء المذاهب الإسلامية في ذلك، وكذلك التعرف على معايير التعسف في استعمال الحق وإمكانية تطبيق تلك المعايير على مسائل البحث، ونظرا إلى أهمية البحث فقد قسمته إلى ثلاثة مباحث. وتحت كل مبحث مطالب، وقد توصل الباحث إلى وجود خلاف في حكم أضحية الآباء عن الأبناء صغارا وكبارا، وكذلك في حكم تضحية الأبناء عن الآباء أمواتا وأحياء، كما توصل الباحث إلى إمكانية تطبيق معايير التعسف على تلك الأحكام كما بينه البحث. |
