| المستخلص: | أعد البحث للتفريق بين القاعدة الفقيه والنظرية الفقهية، ثم بين نظرية الضرورة وبعض القواعد الفقهية المتعلقة بها مع إدراج نماذج تطبيقية على قاعدة: المشقة تجلب التيسير والتي من أهمها. تيسرات السفر، والمرض، والإكراه، والنسيان، والجهل، والعسر، وعموم البلوى، والنقص، ونماذج تطبيقية على قاعدة: الضرورات تبيح المحظورات ومن أهمها: محظورات المطعوم والمشروب، ومحظورات النطق بالكفر، ومحظورات الكذب، ومحظورات أخذ مال الغير، وغيرها كثير وأن القاعدة الفقهية أقرب ما تكون إلى مقاصد الشريعة فبينهما رباط كبير، وعروة وثقى. Jurisprudential Rule and Jurisprudential theory with Applied Mod¬els in The Theory of Necessity The research sought to distinguish between the jurisprudential rule and the theory of jurisprudence and then between the theory of necessity and some of the jurisprudential rules related to it with the Stairway of applied models on the rule: “Hardship brings fa¬cilitation”, the most important of which are: travel facilitations, disease, coercion, forgetfulness, ignorance, hardship, and general inferiority. And models applied to the rule: “Necessity permits prohibitions” and the most important: the prohibition of eatable and drinkable, the blasphemy “Kufr” words, the prohibition of lies and the pro¬hibition of taking the money of others etc., that rules of jurispru¬dence are as close as they are to the purposes of Sharia, they have a big link and most trustworthy handhold. |
