| المستخلص: | شرع الله الأحكام لغايات ومقاصد تهدف لتحقيق مصالح الناس في دنياهم وأخراهم، ولما كانت معرفة هذه المقاصد مهمة للمجتهد لضبط عملية الاجتهاد كان لزاما أن يكون مفهوم تلك المقاصد واضحا للمجتهد، وكذا معرفة الطرق العملية التي من خلالها تستنبط المقاصد، ومتى تكون المقاصد حجة، وما هي الضوابط التي يجب مراعاتها عند استنباط المقصد، فجاء هذا البحث للإجابة عن هذه الإشكالات في ثلاثة مباحث: الأول: مفهوم المقاصد لغة واصطلاحا. الثاني: كيفية استنباط المقاصد الشرعية. والثالث: حجية المقاصد الشرعية. وتلخصت أبرز النتائج في التالي: العلاقة العميقة بين معاني المقاصد لغة ومعناها الاصطلاحي، اختلاف الطرق التي سلكها العلماء تبعاً للعصر الذي عاشوا فيه، حجية المقاصد المستنبطة من نصوص قطعية، أهمية الاجتهاد في المقاصد بشكل جماعي في عصرنا الحاضر. God has prescribed rulings for goals and objectives that aim to achieve the interests of people in their world and in the hereafter, and since knowledge of these objectives is important for the mujtahid to control the process of ijtihad, it is imperative that the concept of those objectives be clear to the mujtahid, as well as knowledge of the practical ways through which the objectives are derived, when the objectives are an argument, and what are the controls That must be taken into account when devising the intention, and this research came to answer these problems in three sections: First: The concept of the objectives is a language and convention. The second: How to devise legal objectives. And the third: Authentic legitimate purposes. The most prominent results are summarized in the following: the deep relationship between the meanings of al-maqasid as a language and its idiomatic meaning, the difference in the paths taken by scholars according to the era in which they lived, the authenticity of the objectives deduced from peremptory texts, the importance of ijtihad in the collective intention of the present age. |
