| المستخلص: | إن الملكية قديمة قدم الإنسان نفسه على هذه المعمورة، لما لها من علاقة وطيدة بحيازة الأموال والتصرفات فيها، فهي كانت وما زالت وستبقى هدف البشرية جمعاء في رحلتهم القصيرة على هذا الكوكب. وذلك لأن الإنسان جبل على حب المال والتملك وغريزة الأنانية وحب الذات وأصبحت غريزة حب التملك راسخة في عقول البشر أفرادا وجماعات أمما وحكومات، وأصبحت الملكية مصدر كل المتاعب والبلاوي والويلات التي تلحق بالدول. فكم من صراعات ونزاعات مكثت برهة من الزمن وحروبا استعصى إطفاء حريقها، ويظهر ذلك جليا باستقراء وتتبع أحوال الأمم من خلال ماضيها إلى حاضرها فأول نظام للملكية كان أساسه العرف إنها كانت جماعية في المجتمعات القبلية. بحيث يشترك جميع الأفراد في ملكية الأموال، وذلك ناتج من طبيعة حياتهم التي اقتصرت على بعض الأنشطة البدائية، ثم تطورت عبر العصور إلى ملكية شائعة وبعدها إلى ملكية فردية. ولما جاء الإسلام بنظام العدالة الاجتماعية، معترفا بحق التملك فنظم الملكية على أحسن وجه وضبطها بقواعد وبين لها أحكاما خاصة، وقيد حرية التصرف فيها بعدما كان ذلك مطلقا، كل ذلك كان في سبيل مصلحة المجتمع والدولة معا. Property is as old as man on this planet, because it has a strong relationship with the possession of funds and actions in it, it was and remains and will remain the goal of all mankind in their short journey on this planet. This is because man is a mountain of love for money, possession, selfish instinct and self-love. The instinct of love of possession has become entrenched in the minds of human beings, individuals, groups of nations and governments. Property has become the source of all troubles, nightmares and afflictions. Several conflicts and conflicts have lasted for a while, and wars are difficult to extinguish, and this is evident by the extrapolation and tracing of the nations through their past to their present. The first system of ownership was traditionally based on collective tribal societies. So that all individuals participate in the ownership of funds, as a result of the nature of their lives, which was limited to some primitive activities, and then evolved through the ages into common ownership and then to individual ownership. And when Islam came to the system of social justice, recognizing the right of ownership, we organized the property in the best way and controlled it with rules and had special provisions, and restricted the freedom to dispose of it after it was absolute, all for the benefit of society and the state together. |
