| 520 | |f This research aims to study the relationship between the immunity of the President of the Republic and his political responsibility. Although the constitutionalizing of the principle of political responsibility leads to activating legal security, achieving equality, and consolidating the state's submission to the law, it sparked political and legal controversy on the grounds that presidential immunity aims to protect the most important constitutional institution and guarantee its stability and independence. While the recognition of political responsibility leads to the isolation of the President emanating from the popular will, in this context, we try to clarify that the two principles are not contradictory but rather complementary. | 520 | |d La présente recherche a pour objectif l’étude de la relation entre l’immunité du président de la république et sa responsabilité politique. Bien que la constitutionnalisation de la responsabilité politique ait pour objectif de mettre en oeuvre les principes de sécurité juridique, d’égalité entre les citoyens et la soumission de l’Etat au droit, cela a engendré un vif débat politique et juridique. Partant du principe que l’immunité présidentielle vise à protéger l’institution constitutionnelle clé, et garantir sa stabilité et son indépendance, il en résulte que la reconnaissance de cette responsabilité isole le président élu par la volonté populaire. Dans ce cadre, nous allons tenter d’éclaircir la complémentarité entre ces deux principes. | ||
