| 520 | |a لقد نظم المشرع الجزائري احكام النيابة الشرعية بموجب مواد قانون الاسرة، ويهدف هذا النظام بالأساس الى حماية اموال القاصر لصغر سن او لعارض من عوارض الاهلية، وقد اورد المشرع للنيابة الشرعية صور ثلاث هي: الولاية، الوصاية، والتقديم او القوامة، كما يصطلح على ذلك في الفقه الإسلامي. وقد استمد المشرع الجزائري جملة من الاحكام المتعلقة عموما بالأحوال الشخصية او قانون الأسرة من الفقه الإسلامي، ويرمي بحثي هذا لإبراز اهم مواطن الاختلاف والتشابه بين احكام النيابة الشرعية التي نص عليها المشرع الجزائري وما يقابلها في الفقه الإسلامي بمذاهبه الأربعة الكبرى. | ||
| 520 | |b The Algerian legislator set the provisions of the legal (sharia) prosecution by the articles of the family law. This system principally aims to protect the funds of a young age minor or one of the hindrance of the symptoms of eligibility. The legislator already provided three forms: Guardianship, Trusteeship and submission or ward ship as it is very often referred to in the Islamic fiqh (jurisprudence). The Algerian legislator derived a set of provisions that are relating to personal status or family law from the islamic jurisprudence therefore, this research looks forward to highlighting the most important differences between the provisions of Sharia prosecution which is stipulated by the Algerian legislator and what is corresponding in the Islamic jurisprudence with its four major doctrines. | ||
