| المستخلص: | يعني هذا البحث ببيان أحد طرق بناء الأصول، وهي طريقة تخريج الأصول على الفروع جاء البحث لبيانها مفهومها، وأثرها على أصول الفقه مع التمثيل، وقد أتبعت في ذلك المنهج الاستقرائي، والتحليلي، والاستنباطي، ومن أهم نتائج البحث: التوصل لتعريف جامع لهذه الطريقة، وإجمال أثرها على القاعدة الأصولية، والاختلاف في نسبة الأصول المخرجة للأئمة، وأهم ما يوصى به: ضرورة دراسة موضوع تخريج الأصول على الفروع بشكل أوسع وأشمل؛ لتحقيق القواعد، وبيان العذر في بناء الفروع عليها عند المذاهب، وإرجاع القواعد إلى من أسسها. This research is concerned in clarifying one of the Usuul establishing methods which is generation the Usuul from branches of figh, this research is presented to clarify the meaning and it’s effects on the Usuul Al figh. With examples and I followed the induction, analyzing and generation, the results of this research are establishing a comprehensive identification for this method. And summating it’s effect in the generated “Usuuliah” And The difference in the rate of the generation “Usuuls” to the “Imams”. One of the most important recommendations; the necessity of studying the generating Al Usuul from branches widely and comprehensively to achieve the bases and justifying in relying on the branches according to the doctrines and returning the bases into the related figure.. |
