| المستخلص: | تناولت الدراسة بيان دور أحكام الدستور الأردني في تبني نظام لامركزية إدارية محلية فعالة، وتعود أهمية هذه الدراسة إلى دور اللامركزية الإدارية المحلية في مجال التنمية الشاملة على مستوى الدولة ومستوى الوحدات المحلية، بالإضافة إلى تعزيز النهج الديمقراطي والحوكمة الرشيدة للإدارة العامة.\nهدفت هذه الدراسة إلى الوقوف على الدور الذي تؤديه الأحكام الدستورية في الوصول إلى بيئة تشريعية داعمة لتبني نظام لامركزية إدارية محلية فاعل، يعزز من مسارات التنمية المحلية على مستوى المحافظات.\nوتم بحث هذا الموضوع من خلال دراسة أحكام الدستور الأردني بالمقارنة مع عدد من الدساتير والممارسات الدولية الفضلى، وقد انصبت الدراسة على بيان الضمانات الدستورية لإنشاء وحدات الإدارة المحلية والضمانات الدستورية لفعالية وحدات الإدارة المحلية.\nوقد خلصت الدراسة إلى أن المادة (121) من الدستور قد أرست الأساس الدستوري لإنشاء وحدات الإدارة المحلية في الأردن، إلا أن هذا النص جاء مقتضباً، مما نتج عنه بروز مظاهر نقص بسبب عدم ذكر معايير مماثلة لما ورد في الدساتير المقارنة، وتوصلت الدراسة لعدد من التوصيات في مقدمتها ضرورة إعادة النظر بأحكام الدستور الأردني، وإضافة فصل خاص تحت عنوان "الإدارة المحلية" يخصص لوحدات الإدارة المحلية، على أن يتضمن مواد تعالج القواعد الرئيسة التي درجت الدساتير المقارنة على معالجتها.\n The study described the role of the provisions of the Jordanian Constitution in adopting an effective local administrative decentralization system. The importance of this study is due to the role of local administrative decentralization in the field of comprehensive development at the state level and the level of local units, in addition to promoting the democratic approach and good governance for public administration.\nThis study aimed to identify the role that constitutional provisions play in reaching a supportive legislative environment to adopt an effective local administrative decentralization system that enhances local development pathways at the provincial level.\nThis topic was discussed through the study of the provisions of the Jordanian Constitution compared to several constitutions and best international practices. The study focuses on the constitutional guarantees for establishing local administration units and the constitutional guarantees of the effectiveness of local administration units.\n\nThe study concluded that Article (121) of the Constitution laid the constitutional basis for establishing local administration units in Jordan. However, this provision was brief, resulting in the emergence of deficiencies due to the failure to mention criteria similar to those contained in the comparative constitutions. The study reached a number of recommendations, foremost among them the need to review the provisions of the Jordanian Constitution and add a special chapter entitled “Local Administration” dedicated to local administration units, which should include articles dealing with the main rules that have been dealt with by comparative constitutions.\nThis abstract translated by Dar AlMandumah Inc. 2021 |
