| المستخلص: | يتناول هذا البحث بالدراسة مجمل تدابير الضبط الإداري التي اتخذتها الدولة الجزائرية لمواجهة انتشار وباء فيروس كورونا المستجد ومكافحته، هذا الوباء الذي انتشر في معظم دول العالم بشكل رهيب، وفتك بالعديد من الأرواح، وأصبح يشكل خطرا على الصحة العمومية باعتبارها عنصرا من عناصر النظام العام، كما جعل العالم بأسره يعيش حالة من الذعر والقلق نتيجة تزايد الإصابات والوفيات وانهيار المنظومة الصحية في العديد من دول العالم.\nتبحث هذه الدراسة في مدى فعالية تدابير الضبط الإداري المنصوص عليها في النصوص التشريعية والتنظيمية المشار إليها في البحث، وتأتي أهمية البحث في الموضوع بعد الانتشار الواسع للوباء في العديد من دول العالم ومنها الجزائر، كما تسعى هذه الورقة إلى البحث في التدابير الوقائية والتدابير التكميلية للحد من انتشار الوباء، والسلطات الإدارية المختصة باتخاذ هذه التدابير وتطبيقها بشكل صحيح، كما اعتمدت الدراسة على المنهج الوصفي التحليلي من خلال تحليل العديد من النصوص التشريعية والتنظيمية ذات الصلة بموضوع البحث.\nلذلك تتناول هذه الدراسة السلطات الإدارية المختصة بالضبط الإداري على المستوى المركزي والمحلي وذلك في المطلب الأول، كما تتناول في المطلب الثاني أهم التدابير المتخذة في الجزائر لمواجهة وباء فيروس كورونا، حيث تم تقييد بعض الحريات الأساسية للمواطن وتنظيم المرافق العامة بشكل يتماشى مع الوضع الصحي وغيرها من التدابير. كذلك تتناول الدراسة في المطلب الثالث والأخير تدرج تدابير الضبط حسب ما تضمنته المراسيم التنفيذية المشار إليها في الدراسة.\nوقد خلص البحث إلى جملة من النتائج والتوصيات، والمتمثلة في تقييد الحكومة للعديد من الحريات الأساسية المعترف بها للمواطن، وذلك حفاظا على النظام العام في مدلوله المتعلق بالصحة العامة، مع منح السلطات الإدارية صلاحيات واسعة لمجابهة الوباء والحد من انتشاره، لذا وجب تدعيم هذه التدابير والإجراءات بتدابير أخرى تساير الانتشار الواسع للوباء، مع ضرورة تفعيلها على أرض الواقع من خلال إحاطتها بعقوبات ردعية إضافية حتى يمتثل المواطنون للتدابير الوقائية.\n This research examines the overall administrative control measures taken by the Algerian state to cope with and control the emerging COV epidemic, which has spread terribly in most countries of the world, killed many lives, and has become a threat to public health as an element of public order, and has left the entire world in a state of panic and anxiety as a result of increased injuries, deaths and the collapse of the health system in many countries of the world.\nThis study examines the effectiveness of administrative control measures stipulated in the legislative and regulatory texts referred to in the research, and the importance of research in the subject comes after the widespread spread of the epidemic in many countries of the world, including Algeria. The spread of the epidemic, and the competent administrative authorities to take these measures and apply them correctly. The study also relied on the descriptive analytical approach by analyzing many legislative and regulatory texts related to the subject of the research.\nTherefore, this study deals with the competent administrative authorities at the central and local level in the first requirement, as well as the second requirement, the most important measures taken in Algeria to address the COV epidemic, where some fundamental freedoms of citizens and the regulation of public facilities have been restricted in line with the health situation and other measures. The study also deals with the third and final requirement, including control measures as included in the executive decrees referred to in the study.\nThe research concluded with a number of results and recommendations, which are represented in the government restricting many of the basic freedoms recognized for the citizen, in order to preserve public order in its meaning related to public health, while granting the administrative authorities broad powers to confront the epidemic and limit its spread, so these measures and procedures must be strengthened With other measures that keep pace with the widespread spread of the epidemic, with the need to activate them on the ground by surrounding them with additional deterrent penalties so that citizens comply with the preventive measures.\nThis abstract translated by Dar AlMandumah Inc. 2021 |
