| 520 | |a حرصت الدساتير والمواثيق الدولية لحقوق الإنسان على أن تضمن للمواطنين حقي الانتخاب والترشح باعتباره حقا دستوريا مقدسا، لكنه وبعد التسليم بهذه الهرمية تواجهنا مشكلة التفاصيل التي يتطرق إليها القانون الصادر عن السلطة التشريعية، والتي تفصل ما أجملته القواعد الدستورية المقتضبة. وتبدأ المشكلة بتغييب النص الدستوري وعدم الاحتكام إليه أو بعدم استيعاب مفهومه وأبعاده، خاصة وأن الدستور ليس نصا مغلقا انتهى مفعوله لحظة إقراره، بل هو عمل حي منفتح على الاستنباط المتواصل لحقوق الإنسان وحرياته، وعلى الأخص السياسية منها؛ كونها تمثل حجر الأساس ونقطة الارتكاز للممارسة الفعلية لكافة الحقوق والحريات؛ ولهذا كان ربط الحقوق السياسية بالدستور، الذي يهدف إلى تقييد سلطة المجالس التشريعية وأهواء أغلبياتها المختلفة عن مصادرة أو انتقاص هذه الحقوق.\nوالواقع أن الانتخابات البرلمانية في الكويت أصبحت جزءا من الحياة الدستورية والسياسية في البلاد باعتبارها استحقاقا دستوريا وديمقراطيا ارتضاه المواطنون منهجا لاختيار مؤسساتهم الرقابية، ومع كل انتخابات تثار قضية مدى دستورية بعض الشروط؛ خاصة أنها قد تستر خلفها رغبة في إقصاء بعضهم عن المشهد السياسي، في ظل دستور كفل حق الانتخاب والترشح، وأناط بالقانون تحديد الشروط الواجب توفرها لممارسة هذا الحق.\nوتهدف هذه الدراسة إلى تناول الأساس الدستوري والدولي لحق الانتخاب والترشح، موضحة مفهومه ونطاقه وأبعاده؛ ومن ثم تتناول كافة الشروط التي تطلبها القانون في المرشح والناخب في الكويت، ومدى مطابقتها لأحكام الدستور.\nوبصفة عامة، سجلنا وجود خلل ومثالب في تلك القوانين المنظمة لهذه الحقوق؛ إذ إن الخلل الحقيقي يبقى على مستوى الممارسة الميدانية، من خلال التشريعات التي أقرها مجلس الأمة وتطبيقات السلطة التنفيذية لها؛ لأن دراسة النصوص الدستورية وحدها لا تعطي صورة صادقة لما يتمتع به الأفراد من الحقوق والحريات. فعلى مستوى مؤسسة مجلس الأمة، سجلنا ما يعبر عن قصور المشرع الكويتي في مفهوم التدخل التشريعي في مجال تنظيم الحقوق السياسية المتعلقة بحق الانتخاب والترشح، حتى كاد أن يعصف ويزهق النص الدستوري الكافل لتلك الحقوق. وفي خاتمته، جدد البحث دعوة المشرع الكويتي لتبني عدد من الاقتراحات، سواء على صعيد تعديل الدستور أو القوانين، بالإضافة أو الإلغاء.\n | ||
| 520 | |f Constitutions and international human rights covenants have been keen to guarantee citizens the right to vote and run as a sacred constitutional right. However, after recognizing this hierarchy, we are faced with the problem of the details covered by the law promulgated by the legislative authority, which details the summary of the constitutional rules.\nThe problem begins with the absence of the constitutional text and the failure to invoke it or the failure to comprehend its concept and dimensions, especially since the constitution is not a closed text that expires at the moment of its approval, but rather is a live-action open to the continuous deduction of human rights and freedoms, especially political ones. Being the cornerstone and focal point for the actual exercise of all rights and freedoms; Hence, linking political rights to the constitution, which aims to restrict the power of legislatures and the whims of their various majorities from confiscating or diminishing these rights.\nIn fact, the parliamentary elections in Kuwait have become part of the constitutional and political life in the country as a constitutional and democratic entitlement that citizens have accepted as a method for choosing their oversight institutions. With each election, the issue of the constitutionality of some conditions arises. Especially since it may hide behind it a desire to exclude some of them from the political scene, in light of a constitution that guarantees the right to vote and to run for election, and the law is entrusted with determining the conditions that must be met for the exercise of this right.\nThis study aims to address the constitutional and international basis for the right to vote and to run for election, explaining its concept, scope, and dimensions; and therefore, it deals with all the conditions required by law in the candidate and voter in Kuwait, and their compliance with the provisions of the constitution.\nIn general, we recorded flaws and drawbacks in those laws regulating these rights; The real flaw remains at the level of field practice through the legislation approved by the National Assembly and its implementation by the executive authority. Because studying the constitutional texts alone does not give an accurate picture of the rights and freedoms enjoyed by individuals. At the level of the National Assembly institution, we recorded what expresses the failure of the Kuwaiti legislature in the concept of legislative interference in the field of regulating political rights related to the right to vote and candidacy, to the extent that it almost destroyed the constitutional text that guarantees those rights.\nIn its conclusion, the research renewed the call for the Kuwaiti legislature to adopt some proposals, whether in terms of amending the constitution or laws, by adding or repealing. \nThis abstract translated by Dar AlMandumah Inc. 2021 | ||
