| المستخلص: | يهدف هذا البحث إلى دراسة الأحكام والمسائل الناظمة لصفة المدعي بالدعوى الجنائية من الناحيتين الموضوعية والإجرائية، وتم تقسيم البحث إلى ثلاثة مباحث تتناول بالدراسة الطبيعة القانونية للصفة في الدعوى الجنائية، ومقارنتها مع المصلحة، والتفرقة بين الصفة القضائية والصفة في الدعوى، كما يتناول البحث الصفة في الادعاء العام، والصفة في الدعوى الجنائية الخاصة للشخص الطبيعي على تعدد مراكزه القانونية، والشخص الاعتباري، ثم عن طبيعة الدفع بعدم الصفة في الدعوى الجنائية، وعن تقدير وجودها، ثم أثر هذا الدفع على الدعوى الجنائية. This research discusses the provisions and issues regulating the capacity of the plaintiff in the criminal case, from the substantive and procedural aspects. The research is divided into three sections. These sections deal with the legal nature of the capacity in the criminal case, its comparison with the interest, and the distinction between the judicial capacity and the capacity in the case. The research also deals with the capacity in the public prosecution, the capacity in the private criminal case of the natural person with the multiplicity of his legal positions, the legal person, and then the nature of challenging non-capacity in the criminal case, and the assessment of its existence, then the effect of this challenge on the criminal case. |
