| المستخلص: | الحمد لله رب العالمين، والصلاة والسلام على أشرف الأنبياء والمرسلين، نبينا محمد، وعلى آله وصحبه أجمعين، أما بعد: تناول البحث مسألة الاحتجاج بالخلاف، وهي من المسائل المعاصرة التي كثر الوقع فيها، من بعض المتصدرين للفتوى، ومن عوام الناس، بحيث يجعل الخلاف الفقهي في المسألة، مبررا للأخذ بأي قول شاء منها، حتى صار أحدهم يبني اختياره للقول ليس بحسب ما تقضيه النصوص الشرعية، وإنما يبحثه عن القول الذي يوافق هواه، وما تشتهيه نفسه، محتجا بالخلاف، فأصبح الخلاف وسيلة إلى اتباع هواه، لا إلى تقواه، وللاحتجاج بالخلاف آثار ومفاسد عظيمة. وقد جعلت هذا البحث في مقدمة، وخمسة مباحث، وخاتمة، بينت فيه حقيقة الاحتجاج بالخلاف، وأمثلته، وصور الاحتجاج بالخلاف، وحكم الاحتجاج بالخلاف، وأدلة كل قول، ثم بينت الراجح في حكم الاحتجاج بالخلاف، وذكرت الصور التي يجوز فيها الاعتداد بالخلاف. أسأل الله عز وجل أن يوفقني للصواب والسداد، وأن يغفر لي ما كان فيه من خطأ، أو تقصير، والله تعالى أعلم، وصلى الله وسلم على نبينا محمد، وعلى آله، وصحبه، وسلم. ouched on the issue of protest dispute, one of the contemporary issues that many fall into it, from some of the leaderboard for the fatwa, and ordinary people, so that makes the dispute doctrinal in the matter, justification for taking any words of wills of them, until he became one of them builds his choice to say, not according to what you spend religious texts, but looking for the word that he wishes, and desires himself, arguing the dispute, the became a means to follow the desires, not to his piety, and to protest the effects of the controversy and great evils. I have made this research in an introduction, five chapters, and a conclusion, in which it shows the truth of protesting in dispute, its examples, images of protest in dispute, the ruling on invoking disagreement, and the evidence for each saying, then showed the most correct ruling on the ruling of invoking disagreement, and mentioning the images in which it is permissible to argue with disagreement. |
