| المستخلص: | Député F.L.N et Président de l’Assemblée Nationale Constituante, Ferhat ABBAS est l’auteur d’un «projet» de Constitution qui ne fut jamais publié et tombera dans l’oubli lorsque le gouvernement et le Bureau Politique se chargèrent de rédiger la Constitution de 1963. De nature libérale et démocratique, l’écrit projette l’instauration d’un régime parlementaire à travers un gouvernement de législature dans lequel l’Assemblée nationale, expression de la souveraineté nationale, est au sommet de la hiérarchie des organes constitutionnels. Investis par la chambre des députés, le Président du Conseil des ministres et son cabinet gouvernent et sont responsables devant elle qui peut les renverser par le vote de défiance ou la motion de censure. Elu par le peuple, le Président de la République symbolise l’unité de la nation, il est le gardien de la Constitution et représente la pérennité des institutions. Le Conseil supérieur de la magistrature matérialise l’indépendance du pouvoir judiciaire. FLN deputy and President of the National Constituent Assembly, Ferhat ABBAS is the author of a "draft" of the Constitution which was never published and will fall into oblivion when the government and the Political Bureau took charge of drafting the Constitution of 1963. Of a liberal and democratic nature, the document projects the establishment of a parliamentary system through a legislative government in which the National Assembly, expression of national sovereignty, is at the top of the hierarchy of constitutional organs. Invested by the Chamber of Deputies, the President of the Council of Ministers and his cabinet govern and are accountable to it who can overthrow them by a vote of no confidence or a motion of censure. Elected by the people, the President of the Republic symbolizes the unity of the nation, he is the guardian of the Constitution and represents the sustainability of institutions. The Superior Council of the Judiciary embodies the independence of the judiciary. |
