| 520 | |b In this article we highlight the roles and work of the administrative judiciary, to show their distinctiveness compared to the work and nature of the regular judiciary, because it is a special type of jurisprudence, where reflection and creativity are important and necessary of its effectiveness and ensure that the objective of its existence is achieved. The creation of new rules, the introduction of new elements within the control gradually, giving advisory opinions, the conduct of studies and researches to improve administrative work, and intervention to ensure execution of judgments; are clearly indicative of the uniqueness of the work of this judiciary and require an analytical study for its meaning and highlight its importance . We choose French administrative judiciary as a model for comparison with national judiciary. | ||
| 520 | |a نسلط الضوء في هذا المقال على أدوار القضاء الإداري وعمله، ليس لتعدادها ولكن لتبيان تميزها مقارنة بأعمال وطبيعة القضاء العادي، فالقضاء الإداري نوع خاص من القضاء يعد الاجتهاد والإبداع فيه عنصرين هامين وضروريين لفعاليته وضمان تحقيق الهدف من وجوده. إن ابتداع قواعد لم تكن موجودة قبل عرض النزاع وإدخال عناصر جديدة ضمن الرقابة شيئاً فشيئاً، وتقديم الآراء الاستشارية وإجراء الدراسات والبحوث ترقية للعمل الإداري، وأكثر من ذلك التدخل لضمان التنفيذ؛ هي أدوار تدل بوضوح على تفرد عمل القضاء الإداري وتستدعي وقفة تحليلية لحقيقة معناها وإبراز أهميتها، وقد اخترنا القضاء الإداري الفرنسي كنموذج للمقارنة بينه وبين القضاء الوطني. | ||
