| المستخلص: | هذا البحث يسعى إلى بيان منهج الشيخ خليل بن إسحاق المالكي في مختصره الفقهي، وقبل الشروع في ذلك المقصد أبان البحث لمحات مهمة من حياة الشيخ خليل العلمية والاجتماعية، ثم بعد ذلك أوضح منهج خليل متتبعا زمن تأليفه وقيمته العلمية وثناء العلماء عليه وترتيبه أو تبويبه، ولغته وكثرة فروعه وشروحه وأسلوبه وقواعده واصطلاحه ومصادره، وأنه مشى في تريبه على تريب ابن الحاجب والمدونة وأنه امتاز بالدقة في استعمال اللغة وحسن الترتيب بين المسائل مع مراعاة جمع النظائر وأنه له أسلوبا خاصا في تأليفه ومنه أنه لا يمثل إلا لنكتة، ومنه أنه إذا جمع مسائل مشتركة في الحكم والشرط نسقها بالواو، فإذا جاء بعدها بقيد علمنا أنه منطبق على الجميع، وإن كان القيد مختصا ببعضها أدخل عليه كاف التشبيه. This research seeks to clarify the method of Sheikh Khalil bin Ishaq Al-Maliki in his juristic brief, and before embarking on that destination, the research showed important glimpses of Sheikh Khalil’s scientific and social life, then after that he clarified Khalil’s method, tracing the time of his composition, its scientific value, the scholars ’praise of it, its arrangement or tabulation, and its language And his many branches, annotations, style, rules, terminology, and sources, and he walked in his work on the experience of Ibn Al-Hajeb and the Code and that he was characterized by accuracy in the use of language and good tribulation between issues while taking into account the collection of isotopes and that he has a special method in his composition and from it that it only represents a joke, and that if he collects common issues In the ruling and the condition, it was coordinated by Waw, and if it came after it with a restriction we knew that it applies to everyone, and if the restriction is related to some of them, then he should adequately compare the analogy. |
