| 520 | |a للنفس البشرية حرمة عظيمة في الإسلام بصرف النظر عن لون أو جنس أو ديانة هذه النفس، فحرم الإسلام قتلها، وتوعد من يفعل ذلك بالعقاب الشديد، ومن الأحكام التي تترتب على قتل النفس: الدية، ولأهميتها أفرد لها الفقهاء بابا عظيما في كتبهم يفصلون فيه أحكامها، وفي هذا البحث سأتعرض لمسألتين من مسائل الدية عدهما البعض من المسائل الشائكة، بينما ذهب البعض الآخر إلى الطعن في الإسلام بمثلهما، وهما مسألتا: دية المرأة المسلمة، ودية المواطن غير المسلم، ففي المبحث الأول: قمت بتعريف الدية، ومشروعيتها، وموجبها، وأصولها، بينما تناولت في المبحث الثاني: دية المسلمة: الدراسة الفقهية والرؤية التجديدية، وأما المبحث الثالث فقد تناولت فيه: دية المواطن غير المسلم: الدراسة الفقهية والرؤية التجديدية، ثم كانت خاتمة البحث وذكرت فيها أهم النتائج والتوصيات. | ||
| 520 | |b The human soul has a great sanctity in Islam, regardless of its color, gender or religion, so Islam has prohibited killing it, and has threatened anyone who does so with severe punishment. Among the rulings that result in killing the soul: blood money (diyya), and for its importance, the jurists singled out a great chapter in their books detailing its rulings. In this research, I will deal with two of the blood money questions, which some counted as thorny and troublesome issues, while others used both of them to attack Islam. These two issues are: the blood money (diyya) of a Muslim woman, the blood money of a Muslim woman, and the blood money of a non-Muslim citizen. In the first topic: I defined the blood money, and declared its legitimacy, its reason, as well as its origins, while in the second topic: I dealt with the blood money (diyya) of a Muslim woman as a jurisprudential study and an innovative vision. In the third topic: I tackled the blood money (diyya) of a non-Muslim citizen as a jurisprudential study and an innovative vision. Then the conclusion of this research in which I mentioned the most important results and recommendations. | ||
