| المستخلص: | لقد اهتم الأصوليون بدراسة كافة أنواع الأدلة؛ التي تعد منهل استنباط الأحكام الشرعية، ومظان استخراج الحكم الإلهية، وقد نال معظم تلك الأدلة عندهم حظاً واسعاً من البحث والاستقصاء، وتمحيص الأقوال والحجج، والاختيار والترجيح، ولم ينل البعض منها ذلك الحظ الكبير من الاعتناء والتوسع، ويعد [الاقتران] من ذلك البعض القليل الذي يحتاج إلى مزيد من البحث والتدقيق، ومن هنا تبرز أهمية هذا البحث؛ حيث يتناول موضوع [الاقتران] كدليل من الأدلة المختلف في حجيتها عند الأصوليين، سبراً لأغوار ماهيته، وتحديداً واضحاً لمفهومه، وتحريراً وتحقيقاً لموضع النزاع فيه، وبياناً شافياً للراجح وسبب ترجيحه في تلك المسألة الدقيقة من مسائل الأصول، مع الاعتناء بالتطبيق على النصوص الشرعية، خروجاً بالخلاف في حجيته من حيز التنظير إلى واقع التطبيق على نصوص الوحي؛ وذلك بتتبع أنظار المجتهدين في فهم بعض النصوص الشرعية المشتملة على ما ينطبق عليه مسمى [الاقتران] عندهم؛ لاستجلاء أقوالهم فيها، وما يترتب على ذلك من الفروع الفقهية. The fundamentalists were largely interested in examining all sorts of evidence which constitute the source from which legal provisions are derived as well as being the origin of theosophy. A great deal of such evidence got largely researched, authenticated, thoroughly examined in terms of arguments, statements, selection and preference. However, some little evidence did not receive such portion of interest or extensive study. (Contiguity) is seen as part of that little evidence which needs more research and authentication. Accordingly, the importance of this research seems apparent since it handles the topic of (Contiguity) as an arguable evidence for the fundamentalists. Hence, the research emphasizes tracing the origins of (Contiguity), introducing a clear-cut definition of the concept, defining and examining its dialectic issues, deciding on a panacea that includes the preponderant statements giving reasons for their preponderance with relevance to such accurate fundamental issues, stressing application on legal texts, turning attention from argument on discord in the field of theorizing into the reality of application on revealed texts through following independent views on some legal texts that contain what is conceptualized as (Contiguity) to examine the relevant statements and the associated consequences on jurisprudential categories. |
