| المستخلص: | يهدف هذا البحث إلى إبراز أصول وقواعد الإفتاء عند الشيخ جاد الحق على جاد الحق شيخ الأزهر الأسبق وذلك من خلال أعماله وأبحاثه في هذا المجال. وتحقيقاً لهذا الهدف بدأت بدراسة مختصرة عن شخصية هذا الإمام، ثم تكلمت عن الإفتاء حقيقته، وأهميته، وعلاقته بالقضاء، ثم تكلمت عن المفتي والمستفتي وشروطهما، ثم تكلمت عن أحكام الإفتاء الأصولية من خلال رؤية الشيخ جاد الحق. ثم قمت بدراسة ضوابط الإفتاء عند الشيخ جاد الحق والمصادر التي اعتمد عليها، ثم تكلمت عن قواعد الإفتاء عنده. وقد اعتمد الباحث في دراسته على المنهج الاستقرائي بهدف تتبع آراء العلماء في القضايا المطروحة، مع بيان رؤية الشيخ جاد الحق الأصولية في كل ذلك، وذكر نماذج من فتاويه. ومن أبرز ما توصلت إليه أن المفتي يجب أن يلتزم في الفتوى بكل ما يوصله إلى صحتها، وما فيه صلاح أمور الناس والسير بهم في طريق وسط دون إفراط أو تفريط، وأن فهم الواقع ومعرفة الناس وفهم عوائدهم وأعرافهم أمور ضرورية لصحة الفتوى. وأن الشيخ جاد الحق كان إماماً في الفقه والأصول مع شدة التدين والتواضع والحزم، يشهد له بذلك كل من عرفه، ويمكننا أن نلحظ ذلك من مواقفه المناهضة للباطل والتي أعلن رأيه فيها بصراحة وشجاعة. This research aims to highlight the origins and rules of the fatwa when Sheikh Gad al-Haq Ali Gad al-Haq, former Sheikh of Al-Azhar, through his work and research in this area. To this reason I started with a brief study on his character, then I talked about the fatwa, what it is, its importance, its relationship with the judiciary, then I talked about the mufti and the mufti and their conditions, then I talked about the rules of the fundamentalist fatwa through the vision of Sheikh Gad al-Haq. Then I studied the approach of Al sheikh in fatwa and the sources on which he relied, and then talked about the rules of the fatwa. The researcher relied on the inductive method to track the opinions of scientists in the issues at hand, with a statement of Sheikh Gad al-Haq's fundamentalist vision in all this, and mentioned examples of his fatwas. One of the most important findings is that the mufti must adhere to the fatwa in all that leads to its health, including the goodness of people and walk them in a middle way without excessive or excessive, and that understanding the reality and knowing people and understand their returns and customs are essential to the validity of the fatwa. And that Sheikh Gad al-Haq was an imam in jurisprudence and assets with the severity of religiosity and modesty and firmness, attested to him by everyone who knew him, and we can note this from his anti-false positions, which declared his opinion frankly and courageously. |
