| 520 | |a يتناول هذا البحث الإجراءات الاحترازية المعمول بها في دولة الكويت للحد من انتشار عدوي فيروس كورونا المستجد، حيث إن التعامل مع هذا الفيروس هو مما طرأ حديثا على المشهد العالمي وبشكل غير مسبوق من حيث سلوك هذا الفيروس طبياً والإجراءات المتخذة حياله من قبل كافة الدول، وبطبيعة الحال فقد برزت العديد من التساؤلات حول الأحكام الفقهية والتأصيل الشرعي لهذه الإجراءات، وتأتى هذه الورقة للإجابة عن مدي توافق الإجراءات المتبعة في دولة الكويت للحد من هذا الوباء والقرارات والقوانين ذات العلاقة مع أحكام الشريعة الإسلامية وبيان التأصيل الشرعي لها، وقد اعتمدت في هذا البحث على المنهج الوصفي التحليلي القائم على عرض وبيان وتحليل الأطر القانونية والفقهية وما يعضدها من شواهد تاريخية مرتبطة بمشكلة الدراسة وأهدافها. وقد توصلت هذه الورقة إلى أن تلك الإجراءات هي في محصلتها تطبيق لمقاصد الشريعة الإسلامية والتي مناطها الضرورات الخمس ومنها حفظ النفس، فكل ما يتوصل به إلى حفظ النفس البشرية فهو مطلب شرعي وبالتالي فإن هناك توافق بين القانون والقرارات المعمول بها في دولة الكويت مع الشريعة، وتوصي الباحثة بدراسة المستجدات والنوازل الطبية والمالية المتعلقة بفيروس كورونا المستجد دراسة فقهية، ووضع معايير شرعية للمسائل الطبية المتعلقة بالتعامل مع الأوبئة. | ||
| 520 | |b This research displays the precautionary measures followed in the State of Kuwait to limit the spread of the emerging Coronavirus infection. This virus has broken out lately and it quickly dominates the scene globally in an unprecedented way in terms of its clinical behavior and the measures followed by all countries of the world. Naturally, a lot of inquiries into the jurisprudential provisions and the objectives of Sharia concerning those measures have come to the ground. Accordingly, this research is designed to answer the question of how far the measures followed in the State of Kuwait to limit the spread of this pandemic are compatible with the orders and laws related to the provisions of Islamic Sharia as well as clarifying their legal origins. The research applies the descriptive analytical approach as based on presenting, explaining and analyzing the legal and jurisprudential frameworks and the historical clues related to the issue of the study and its goals. The research has concluded that all those measures go with the objectives of Islamic Sharia which ensures preserving the five necessities such as preserving the self. Consequently, all what leads to preserving the self is a legal objective. Therefore, the orders and measures followed in the state of Kuwait are compatible with the Islamic Sharia. Finally, the researcher recommends studying, jurisprudentially, the developments as well as the medical and financial calamities related to the emerging Corona virus. She also suggests setting legal standards for the medical issues related to epidemics. | ||
