| المستخلص: | الأصل في الالتزام الصرفي أن كل موقع على الورقة التجارية يكون ملتزما بوفاء قيمتها متى امتنع المدين الأصلي عن ذلك، طبقا لمبدأ استقلال التواقيع، وفي حال امتناع المدين الصرفي يكون للحامل الرجوع على الساحب وباقي الموقعين بعد قيامه باحتجاج عدم الوفاء. إلا أن هذا الطريق يمكن اختصاره من خلال زيادة في الضمانات التي تلزم المدين الصرفي بالوفاء، من خلال التشدد على المدين للوفاء بقيمة الورقة التجارية. وهذه الضمانات أقرها المشرع بموجب أحكام قانون الصرف وفي مجال دراستنا المتمثلة بالورقة التجارية الحوالة فإن هذه الضمانات هي (ضمان مقابل الوفاء وضمان القبول والضمان العام). لذلك جاء هذا البحث محاولة جادة من قبل الباحث للتعرف على هذه الضمانات وتحديدها وبيان شروطها وآثارها. وإن معالجة الموضوع تمت في ظل أحكام قانون الصرف المشار إليها في قانون التجارة العراقي النافذ رقم ٣٠ لسنة ١٩٨٤ والقوانين المقارنة.
