| المستخلص: | يتناول هذا البحث الاحتياط عند الحنفية من حيث مفهومه ودلالته وأثره في النص والاجتهاد، واستعمال الفقهاء والمجتهدون له، حيث قام الباحث بتعريف مفهوم الاحتياط لغة واصطلاحا، ومناقشة التعريفات مناقشة علمية عقلية شرعية وصولا للتعريف المناسب للاحتياط عبر عرض العديد من التعريفات سواء من المذهب الحنفي أو غيره، من ثم بيان حجيته، ثم أثره في أحكام الطهارة والعبادات عند السادة الحنفية رضوان الله عليهم. ويهدف البحث لبيان أهمية الاحتياط في العبادات، كونها تقوم على الأحوط لدى المكلف، وإبراء ذمته بيقين، والخروج عن العهدة، لأن السبب الرئيس لوجود الإنسان وخلقه هو العبادة، فكان الأحرى الاحتياط لها؛ لتأديتها على الوجه المطلوب، فكان الفقهاء يتحرون الدقة والحذر في أمور العبادة أكثر من غيرها، فكان الاحتياط مرجحا قويا عند تساوي الحجج، أو عند الاشتباه في الأمر، فلم يكن الاحتياط مصدراً رئيسا مستقلاً ينظر إليه كبقية المصادر، وإنما تجده عاملا رئيسا في العديد من المصادر التشريعية من قرآن وسنة وإجماع وقياس، فتجد الاحتياط حاضراً في تلكم المصادر، فكان الأصل عند المجتهد في المذهب الحنفي أن العبادات تقوم على الاحتياط. ويظهر البحث أن الاحتياط يعتبر عاملاً من عوامل الترجيح، وأداة من أدوات الاجتهاد، وأن الفقهاء قد استعملوا الاحتياط في كثير من فروعهم الفقهية سواء كان باستخدام كلمة الاحتياط أو الأحوط نصا، أو ما يؤدي عملها أو يقوم مقامه، مثل: الاستحباب، والأفضل وغيرها، فكان الاحتياط عاملا رئيسا لضمان خروج المكلف عن العهدة، وإفراغ ذمته بيقين. This research deals with the precautionary provisions of the At Hanafia Scholars in terms of its concept, definition, and significance, and its impact on the text and jurisprudence, and the use of jurists and diligents to it, where the researcher defined the concept of reserve terminology and language, and discuss the definitions in a scientific, intellectual and legality discussion, reaching the appropriate definition of reserve through the presentation of many definitions, (Hanafi) or other doctrine, then the statement of his Authentic, and then the impact on the provisions of water and worship at the masters of the (Hanafis), may God be pleased with them. It is intended to show the importance of precaution in the acts of worship, if it is based on the precaution of the Legally competent, and the discharge of his obligation with certainty, and out of custody, because the main reason for the existence of man and his creation is worship, was rather reserved for them; to perform it in the required manner, the jurists were careful and careful in matters of worship, The reserve was not a strong independent source, but it was found to be a major factor in many legislative sources of Quran, (Sunnah), consensus and measurement. The reserves are present in these sources. The origin in the essence of the diligent in the (Hanafi) doctrine that the acts of worship based on precaution. The researcher finds that the precaution is a factor of weighting, and one of the tools of diligence, and that the jurists have used the precaution in many of their branches of jurisprudence, whether using the word precaution or precautionary text, or what leads to them such as: Desirability, and better and others, The precaution was a key factor to ensure that the Legally competent was out of custody and discharged with certainty. |
