| المستخلص: | تدور رحى هذه الدراسة المتعلقة بالاتجاه الإسلامي للنظام الدستوري الكويتي، حول حقيقة تاريخية، ونتيجة مترتبة عليها، وآثار تولدت عن هذه النتيجة. فأما الحقيقة التاريخية، فهي الطابع الإسلامي الراسخ والمتجذر في أعماق المجتمع الكويتي منذ تأسيس الكويت ولغاية تاريخ استقلالها، والذي انعكس على النظام السياسي للمجتمع في تلك الفترة وما بعدها. وأما النتيجة المنبثقة عن الحقيقة السابقة فهي الاتجاه الإسلامي الواضح للدستور الكويتي الحالي (دستور 1962). وقد كان من أهداف دراستنا تسليط الضوء على هذا الاتجاه من خلال استعراض وتحليل مجموعة من النصوص الدستورية التي أضفت على الدستور طابعا إسلاميا جليا لا يمكن إخفاؤه، ولا يقبل من السلطات العامة عدم الالتزام بمقتضياته. وأما الآثار، فنعني بها العلامات التي أحدثتها النتيجة السابقة في معالم السياسة التشريعية في الدولة، أو تلك التي يفترض أن تحدثها. وهي خمسة آثار رئيسية، تم عرضها وتفصيلها في نهاية هذا البحث، باعتبارها ثمرة من ثمرات الاتجاه الإسلامي للنظام الدستوري الكويتي. This study, related to the Islamic trend of the Kuwaiti constitutional system, revolves around a historical reality, the relevant consequences and the impacts resulted from it. As to the historical reality, it is the deeprooted Islamic character on the Kuwaiti community since the establishment of Kuwait to the day of independence, which reflected on the political system of the society during and beyond this period. As to the consequence emanating from the foregoing reality, it lies in the clear Islamic trend of the current Kuwaiti constitution (1962). One of the most significant aims of this study is to shed light on this trend through reviewing and analyzing a variety of the constitutional texts, which added undeniable, clearly apparent Islamic impact on the constitution, which also obliged the public authorities to work within its constraints. As to the issue of the impacts, it is concerned with the marks made by the aforementioned consequence on the outline of the legislative policy in the State, or the ones it supposedly made. It is five main implications that are viewed and discussed in details at the end of this study as being an outcome of the Islamic trend of the Kuwaiti constitutional system. |
