| المستخلص: | يرى الفقه الدستوري أن مجرد النص على سمو الدستور في نصوص الوثيقة الدستورية ليس له قيمة في الواقع العملي، مالم توجد ضمانات تمنع أي انتهاك محتمل لقواعده ومبادئه أو تبطل وتزيل هذا الانتهاك وأثاره. إن الأنظمة الدستورية الحديثة قد اعتمدت رقابة الدستورية وجعلتها ركنا من أركان النظام الدستوري كأساس للدولة القانونية. فمن الدساتير من تسند الرقابة إلى هيئة ذات تشكيل سياسي، فتنظم رقابة سياسية سابقة على صدور القانون، تتولاها هيئة سياسية، ومن الدساتير من تفضل الرقابة القضائية وهي رقابة لاحقة على صدور القانون ونشره. أخيرا يسعى هذا البحث إلى تحديد الأنظمة الدستورية في العراق وبيان مجالات الرقابة القضائية على دستورية القوانين لكل منها. Constitutional jurisprudence holds that the mere provision of the supremacy of the Constitution in the texts of the constitutional document has no value in practice, unless there are guarantees that prevent any possible violation of its rules and principles or invalidate and remove this violation and its effects. Modern constitutional systems have adopted control over the constitutionality of laws and made them a cornerstone of the constitutional order as the basis of the legal state. From the constitutions of the censorship is assigned to a body of political formation, organizing political control before the issuance of the law, and a political body, and from the constitutions of those who prefer judicial control, which is a subsequent control over the issuance and publication of the law. Finally, this research seeks to identify the constitutional systems in Iraq and to clarify the areas of judicial control over the constitutionality of laws for each. |
