| المستخلص: | عقود B.O.T تعد أحد وسائل تمويل مشروعات إنشاء المرافق العامة عن طريق القطاع الخاص سواء مستثمر محلي أو مستثمر أجنبي، دون أن تحمل الموازنة العامة مزيدا من الأعباء ، أو تضطر الدولة إلى اللجوء للاقتراض أو فرض مزيد من الأعباء على مواطنيها ، كما تمكن مشروعات ال B.O.T من أقامه مشروعات تقدم خدمات لجميع أفراد المجتمع، ومن إيجاد فرص للعمالة الوطنية وتدريبهم وتأهيلهم ونقل التكنولوجيا إلى الدولة، بل وأتساع مجال المنافسة داخل الدولة بما يعود بالفائدة في صورة زيادة الإنتاج ووفرته، ومن ثم انخفاض الأسعار للمستهلكين ، والارتقاء بجودة السلع.\nوهناك العديد من طرق تمويل المشروعات المقامة وفقا لعقود البوت، كما أن المؤسسات التمويلية المقرضة تتطلب العديد من الضمانات القانونية حرصا على استرداد مبلغ القرض وفوائده.\nوسوف نتناول دراستنا في مباحث ثلاثة على النحو التالي:\nالمبحث الأول: الفلسفة التمويلية لعقود B.O.T.\nالمبحث الثاني: طرق تمويل المشروعات المقام وفقا لعقود B.O.T\nالمبحث الثالث: الضمانات القانونية لتمويل عقود البوت B.O.T\n B.O.T contracts are one of the means of financing public utility projects through the private sector, whether through a local investor or a foreign investor, without placing more burdens on the public budget or forcing the State to resort to borrowing or imposing more burdens on its citizens. The B.O.T projects also enable setting up projects that provide services to all members of society, create opportunities for national employment, training and rehabilitation, transfer technology to the State, and even broaden competition within the State to benefit in the form of increased production and availability, and consequently lower prices for consumers, and improve the quality of goods.\nThere are many ways to finance projects established according to the B.O.T contracts. The lending institutions require many legal guarantees in order to recover the loan amount and interest.\nWe will address it here in three chapters as follows:\nFirst Chapter: Financing Philosophy for B.O.T Contracts.\nSecond Chapter: Methods of financing projects established according to B.O.T contracts. \nThird Chapter: Legal Guarantees for Financing B.O.T Contracts. \nThis abstract translated by Dar AlMandumah Inc. 2020 |
